S.F. 2013 Section 1. Section 455D.9, subsection 1, Code 2014, is 1 amended to read as follows: 2 1. Land disposal of yard waste as defined by the department 3 is prohibited. However, yard waste which has been separated at 4 its source from other solid waste may be accepted by a sanitary 5 landfill for the purposes of soil conditioning or composting. 6 A sanitary landfill may accept yard waste under any of the 7 following circumstances: 8 a. When the yard waste is separated at its source from other 9 solid waste and is accepted by the sanitary landfill for the 10 purposes of soil conditioning and composting. 11 b. When the yard waste is collected as a result of a severe 12 storm and the yard waste originates in an area declared to be a 13 disaster area in a declaration issued by the president of the 14 United States or the governor. 15 c. When the yard waste is collected as a result of the 16 removal of emerald ash borer infested trees. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to land disposal of yard waste. 21 Currently, land disposal of yard waste is prohibited except 22 yard waste may be accepted by a sanitary landfill for the 23 purposes of soil conditioning or composting. 24 The bill adds two additional circumstances under which yard 25 waste may be accepted for land disposal. The first is when 26 the yard waste is collected as a result of a severe storm and 27 the yard waste originates in an area declared to be a disaster 28 area in a declaration issued by the president of the United 29 States or the governor.
