S.F. 2004 Section 1. Section 598.41, subsection 3, Code 2014, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . l. Whether a parent has a consistent pattern 3 of specific conduct or a specific condition directly relating 4 to the parent-child relationship which is determined by the 5 court to be of a duration or nature that renders the parent 6 unable, for the reasonably foreseeable future, to act as a 7 suitable custodian for the child, including whether the parent 8 has a medically verifiable emotional illness, mental illness, 9 mental deficiency, or substance-related disorder as defined in 10 section 125.2. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill adds to the factors for consideration by the court 15 in determining what custody arrangement is in the best interest 16 of the child, whether a parent has a consistent pattern of 17 specific conduct or a specific condition directly relating to 18 the parent-child relationship which is determined by the court 19 to be of a duration or nature that renders the parent unable, 20 for the reasonably foreseeable future, to act as a suitable 21 custodian for the child, including whether the parent has a 22 medically verifiable emotional illness, mental illness, mental 23 deficiency, or substance-related disorder. 24 -1- LSB 5402XS (3) 85 pf/nh 1/ 1
