136C.3,
subsection
10,
Code
2014,
is

amended
to
read
as
follows:

10.
a.
Adopt
rules
specifying
the
minimum
training
and
3
performance
standards
for
an
individual
using
a
radiation
4
machine
for
mammography,
and
other
rules
necessary
to
5
implement
section
136C.15
.
The
rules
shall
complement
federal
6
requirements
applicable
to
similar
radiation
machinery
and
7
shall
not
be
less
stringent
than
those
federal
requirements.

(1)
Adopt
rules
to
require
that,
by
January
1,
2015,
a
9
facility
where
mammography
services
are
performed
shall
include
10
information
on
breast
density
in
mammogram
reports
sent
to
11
referring
physicians
and
written
statements
sent
to
patients
12
pursuant
to
regulations
implementing
the
federal
Mammography
13
Quality
Standards
Act
of
1992,
Pub.
L.
No.
102-539,
as
amended.

A
written
statement
sent
to
a
patient
who
has
dense
breast
15
tissue,
as
determined
by
the
interpreting
physician
based
on
16
standards
as
defined
in
nationally
recognized
guidelines
or
17
systems
for
breast
imaging
reporting
of
mammography
screening,
18
including
the
breast
imaging
reporting
and
data
system
of
the
19
American
college
of
radiology,
shall
contain
the
following
20
language:
21
Your
mammogram
demonstrates
that
you
may
have
dense
breast
22
tissue.
Dense
breast
tissue
is
very
common
and
is
not
23
abnormal.
However,
dense
breast
tissue
can
make
it
more
24
difficult
to
find
cancer
on
a
mammogram.
A
report
of
your
25
mammography
results,
which
contains
information
about
your
26
breast
density,
has
been
sent
to
your
referring
physician’s
27
office,
and
you
should
contact
your
physician
if
you
have
any
28
questions
or
concerns
about
this
report.

(2)
Nothing
in
this
paragraph
“b”
shall
be
construed
to
30
create
or
impose
liability
on
a
facility
where
mammography
31
services
are
performed
beyond
the
duty
to
provide
the
32
information
set
forth
in
this
paragraph
“b”
.

Nothing
in
this
paragraph
“b”
shall
be
deemed
to
require

a
notice
or
the
provision
of
information
that
is
inconsistent

that

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
5
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
establishes
a
notification
requirement
for
7
mammogram
reports
and
written
statements
to
patients.
The
bill
8
directs
the
department
of
public
health
to
adopt
rules
that
9
require
a
facility
performing
mammography
services
to
include
10
information
on
breast
density
in
reports
sent
to
referring
11
physicians
and
written
statements
sent
to
patients
pursuant
to
12
federal
law
and
rules.
If
a
patient
has
dense
breast
tissue,
13
as
determined
by
the
interpreting
physician
based
on
nationally
14
recognized
guidelines
or
systems
for
breast
imaging
reporting,
15
the
written
statement
must
contain
a
notice
with
the
language
16
provided
in
the
bill.
The
notice
informs
the
patient
that
the
17
mammogram
demonstrates
the
patient
may
have
dense
breast
tissue
18
and
directs
the
patient
to
contact
the
physician
with
further
19
questions
or
concerns.
20
The
bill’s
provisions
are
not
to
be
construed
to
impose
21
liability
on
the
facility
performing
mammography
services
22
beyond
the
duty
to
provide
the
breast
density
information.
23
Facilities
providing
mammography
services
must
comply
with
24
the
bill’s
requirements
by
January
1,
2015.
