S.F. 165 Section 1. Section 455B.263, Code 2013, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 10. The commission shall require each 3 permittee to submit an annual report to the department 4 estimating the total water usage under the permit for the 5 twelve months prior to report submission, and the estimated 6 water supply projected to be available under the permit for 7 the twelve months following the submission of the report. The 8 commission may require more frequent reporting from a permittee 9 if an event described in section 455B.266, subsection 1, 10 occurs. 11 Sec. 2. Section 455B.266, subsection 2, Code 2013, is 12 amended by adding the following new paragraph: 13 NEW PARAGRAPH . 0c. Uses of water for manufacturing or other 14 industrial processes if not related to food production, human 15 health, or national security. 16 Sec. 3. Section 455B.266, subsection 2, paragraph e, Code 17 2013, is amended to read as follows: 18 e. Uses of water for manufacturing or other industrial 19 processes if related to food production, human health, or 20 national security . 21 Sec. 4. Section 455B.298, Code 2013, is amended by adding 22 the following new subsection: 23 NEW SUBSECTION . 7. Require each water system in the state 24 to submit an annual report to the department estimating the 25 total water usage during the previous twelve months, and the 26 estimated water supply projected to be available for the twelve 27 months following the submission of the report. The director 28 may require more frequent reporting from a water system if an 29 event described in section 455B.266, subsection 1, occurs. 30 Sec. 5. APPROPRIATION —— EMERGENCY CONSERVATION MEASURES —— 31 EDUCATION. There is appropriated from the general fund of the 32 state to the Iowa cooperative extension service in agriculture 33 and home economics of Iowa state university for the fiscal year 34 beginning July 1, 2012, and ending June 30, 2013, the following 35 -1- LSB 1592XS (6) 85 tm/nh 1/ 3
S.F. 165 amount, or so much thereof as is necessary, to be used for the 1 purposes designated: 2 For the review and assistance in implementation of emergency 3 conservation measures ordered pursuant to section 455B.266, 4 and for educating the general public regarding effective 5 water conservation measures, including salaries, support, 6 maintenance, and miscellaneous purposes: 7 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 200,000 8 Notwithstanding section 8.33, moneys appropriated in this 9 section that remain unencumbered or unobligated at the close of 10 the fiscal year shall not revert but shall remain available for 11 expenditure for the purposes designated until the close of the 12 succeeding fiscal year. 13 Sec. 6. APPROPRIATION —— WATER PLANS. There is appropriated 14 from the general fund of the state to the department of natural 15 resources for the fiscal year beginning July 1, 2012, and 16 ending June 30, 2013, the following amount, or so much thereof 17 as is necessary, to be used for the purposes designated: 18 For updating plans required under section 455B.262, which 19 shall include plans for droughts including conditions that 20 would necessitate the implementation of priority allocation 21 plans under section 455B.266, including salaries, support, 22 maintenance, and miscellaneous purposes: 23 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 500,000 24 Notwithstanding section 8.33, moneys appropriated in this 25 section that remain unencumbered or unobligated at the close of 26 the fiscal year shall not revert but shall remain available for 27 expenditure for the purposes designated until the close of the 28 succeeding fiscal year. 29 Sec. 7. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 30 immediate importance, takes effect upon enactment. 31 EXPLANATION 32 This bill relates to water usage. 33 The bill creates an annual reporting requirement relating 34 to estimated water usage and estimated water supply for water 35 -2- LSB 1592XS (6) 85 tm/nh 2/ 3
S.F. 165 systems in the state and for permittees for the diversion, 1 storage, and usage of water. The commission may require more 2 frequent reporting from a water system or permittee if certain 3 water shortage-related events occur. 4 The bill amends the prioritization of water usage during 5 restrictions on or suspensions of water use in relation to uses 6 for manufacturing or other industrial processes. 7 The bill appropriates moneys from the general fund of the 8 state to the Iowa cooperative extension service in agriculture 9 and home economics of Iowa state university for FY 2012-2013 10 for the review and assistance in implementation of emergency 11 conservation measures and for educating the general public 12 regarding effective water conservation measures. The bill 13 appropriates moneys to the department of natural resources for 14 FY 2012-2013 for updating certain water plans, which shall 15 include plans for droughts including conditions that would 16 necessitate the implementation of priority allocation plans. 17 The bill takes effect upon enactment. 18 -3- LSB 1592XS (6) 85 tm/nh 3/ 3
