S.F. 149 Section 1. NEW SECTION . 137G.1 Food vendor —— motor vehicle 1 —— background check. 2 A business that operates a motor vehicle primarily marketing 3 the sale and dispensing of ice cream or other food products 4 from or near the motor vehicle to children may require an 5 employee, vendor, contractor, or agent of the business to 6 be subject to a criminal history and abuse registry record 7 background check. The business shall perform the background 8 check by accessing the single contact repository established 9 under section 135C.33, subsection 6. 10 Sec. 2. Section 235A.15, subsection 2, paragraph e, Code 11 2013, is amended by adding the following new subparagraph: 12 NEW SUBPARAGRAPH . (24) To a business which is authorized to 13 perform a background check pursuant to section 137G.1. 14 Sec. 3. Section 235B.6, subsection 2, paragraph e, Code 15 2013, is amended by adding the following new subparagraph: 16 NEW SUBPARAGRAPH . (19) To a business which is authorized to 17 perform a background check pursuant to section 137G.1. 18 EXPLANATION 19 This bill relates to criminal history and abuse registry 20 record checks for certain food vendors. 21 The bill provides that a business that operates a motor 22 vehicle primarily marketing the sale and dispensing of ice 23 cream or other food products from or near the motor vehicle 24 to children may require an employee, vendor, contractor, or 25 agent of the business to undergo a criminal history and abuse 26 registry record check by the business. 27 The bill requires a business that chooses to perform a 28 criminal history and abuse registry record background check to 29 perform such a check by accessing the single contact repository 30 established under Code section 135C.33(6). 31 The information received by the business accessing the 32 single contact repository includes information relating to the 33 following: Iowa criminal history, the sex offender registry, 34 the child abuse registry, and the dependent adult abuse 35 -1- LSB 1710SS (1) 85 jm/nh 1/ 2
