S.F. 125 Section 1. Section 481C.2A, subsection 1, paragraph d, Code 1 2013, is amended to read as follows: 2 d. A producer who enters into a depredation agreement with 3 the department of natural resources shall be issued a set of 4 authorization numbers. Each authorization number authorizes 5 a resident hunter to obtain a depredation license that is 6 valid only for taking antlerless deer on the land designated 7 in the producer’s depredation plan. A producer may transfer 8 an authorization number issued to that producer to a resident 9 hunter who has permission to hunt on the land for which the 10 authorization number is valid. An authorization number shall 11 be valid to obtain a depredation license in any season. The 12 provisions of this paragraph shall be implemented by August 13 15, 2008. A transferee who receives an authorization number 14 pursuant to this paragraph “d” shall be otherwise qualified 15 to hunt deer in this state, purchase a hunting license that 16 includes the wildlife habitat fee, and pay the one dollar a fee 17 of one dollar and fifty cents for the purpose of the deer herd 18 population management program. 19 Sec. 2. Section 483A.8, subsections 1 and 4, Code 2013, are 11 amended to read as follows: 12 1. A resident hunting deer who is required to have a hunting 13 license must purchase a resident hunting license that includes 14 the wildlife habitat fee, in addition to the deer hunting 15 license. In addition, a resident who purchases a deer hunting 16 license shall pay a one dollar fee of one dollar and fifty 17 cents that shall be used and is appropriated for the purpose 18 of deer herd population management, including assisting with 19 the cost of processing deer donated to the help us stop hunger 20 program administered by the commission. 21 4. The commission may provide, by rule, for the issuance 22 of an additional antlerless deer hunting license to a person 23 who has been issued an antlerless deer hunting license. The 24 rules shall specify the number of additional antlerless deer 25 hunting licenses which may be issued, and the season and zone 26 in which the license is valid. The fee for an additional 27 antlerless deer hunting license shall be ten fifteen dollars 28 for residents. 29 Sec. 4. Section 483A.8C, subsection 2, Code 2013, is amended 30 to read as follows: 31 2. A person who obtains a deer hunting license under this 32 section is not required to pay the wildlife habitat fee but 33 shall purchase a deer hunting license and hunting license 34 that does not include the wildlife habitat fee, be otherwise 35 -3- LSB 1401XS (6) 85 av/nh 3/ 6
S.F. 125 qualified to hunt, and pay a one dollar fee of one dollar and 1 fifty cents that shall be used and is appropriated for the 2 purpose of deer herd population management, including assisting 3 with the cost of processing deer donated to the help us stop 4 hunger program administered by the commission. 5 Sec. 5. Section 483A.12, subsection 2, Code 2013, is amended 6 to read as follows: 7 2. A license agent shall retain a writing fee of fifty 8 seventy-five cents from the sale of each license or combination 9 package of licenses except that the writing fee for a free deer 10 or wild turkey hunting license as authorized under section 11 483A.24, subsection 2 , shall be one dollar and twenty-five 12 cents . If a county recorder is a license agent, the writing 13 fees retained by the county recorder shall be deposited in the 14 general fund of the county. 15 Sec. 6. Section 483A.14, Code 2013, is amended to read as 16 follows: 17 483A.14 Duplicate licenses and permits. 18 1. When any license for which a fee has been set has been 19 lost, destroyed, or stolen, the director or a license agent 20 may issue a replacement license, if evidence is available to 21 demonstrate issuance of the original license and a fee of two 22 dollars and twenty-five cents is paid, to be placed in the 23 fish and game protection fund. If, on examination of the 24 evidence, the director or the license agent, as the case may 25 be, is satisfied that the license has been lost, destroyed, 26 or stolen, the director or the license agent shall issue a 27 duplicate license which shall be plainly marked “duplicate” 28 and the duplicate shall serve in lieu of the original license 29 and it shall contain the same information and signature as the 30 original. 31 2. The license agent shall charge a writing fee of 32 one dollar and twenty-five cents and the departmental 33 administrative fee for each duplicate license issued pursuant 34 to this section . S.F. 125 fee. 1 Sec. 7. Section 483A.24, subsection 2, paragraphs c and d, 2 Code 2013, are amended to read as follows: 3 c. Upon written application on forms furnished by the 4 department, the department shall issue annually without fee two 5 deer hunting licenses, one antlered or any sex deer hunting 6 license and one antlerless deer only deer hunting license, to 7 the owner of a farm unit or a member of the owner’s family, 8 but only a total of two licenses for both, and to the tenant 9 of a farm unit or a member of the tenant’s family, but only 10 a total of two licenses for both. The deer hunting licenses 11 issued shall be valid only for use on the farm unit for which 12 the applicant applies pursuant to this paragraph. The owner or 13 the tenant need not reside on the farm unit to qualify for the 14 free deer hunting licenses to hunt on that farm unit. The free 15 deer hunting licenses issued pursuant to this paragraph shall 16 be valid and may be used during any shotgun deer season. The 17 licenses may be used to harvest deer in two different seasons. 18 In addition, a person who receives a free deer hunting license 19 pursuant to this paragraph shall pay a one dollar fee of one 20 dollar and fifty cents for each license that shall be used 21 and is appropriated for the purpose of deer herd population 22 management, including assisting with the cost of processing 23 deer donated to the help us stop hunger program administered 24 by the commission. 25 d. In addition to the free deer hunting licenses received 26 pursuant to paragraph “c” , an owner of a farm unit or a 27 member of the owner’s family and the tenant or a member of the 28 tenant’s family may purchase a deer hunting license for any 29 option offered to paying deer hunting licensees. An owner of a 30 farm unit or a member of the owner’s family and the tenant or a 31 member of the tenant’s family may also purchase two additional 32 antlerless deer hunting licenses which are valid only on the 33 farm unit for a fee of ten fifteen dollars each. 34 EXPLANATION 35 -5- LSB 1401XS (6) 85 av/nh 5/ 6
S.F. 125 This bill increases certain fees relating to the purchase of 1 resident hunting, fishing, and trapping licenses. 2 The bill increases several resident hunting, fishing, and 3 trapping license fees. The bill also increases the wildlife 4 habitat fee, the trout fishing fee, and the migratory game bird 5 fee for residents. 6 The bill increases the fee paid by residents that is used 7 for assisting with the processing of deer donated to the help 8 us stop hunger (HUSH) program and increases the writing fee 9 payable to license agents that issue hunting, fishing, and 10 trapping licenses, and duplicate licenses. 11 -6- LSB 1401XS (6) 85 av/nh 6/ 6
