H.F. _____ Section 1. Section 147.7, Code 2013, is amended to read as 1 follows: 2 147.7 Display of license. 3 1. A board may shall require every person licensed by the 4 board who has a primary site of practice to display the license 5 and evidence of current renewal publicly in a manner prescribed 6 by the board. 7 2. This section shall not apply to a A person who is 8 licensed in another state and recognized for licensure in this 9 state pursuant to the nurse licensure compact contained in 10 section 152E.1 or pursuant to the advanced practice registered 11 nurse compact contained in section 152E.3 . A person licensed 12 in another state and recognized for licensure in this state 13 pursuant to either compact who has a primary site of practice 14 shall , however, maintain display a copy of a license and 15 evidence of current renewal issued by the person’s home state 16 available for inspection when engaged in the practice of 17 nursing in this state. 18 Sec. 2. Section 147.72, Code 2013, is amended to read as 19 follows: 20 147.72 Professional titles and abbreviations. 21 1. a. Any person licensed to practice a profession under 22 this subtitle may append to the person’s name any recognized 23 title or abbreviation, which the person is entitled to use, 24 to designate the person’s particular profession, but no other 25 person shall assume or use such title or abbreviation, and no 26 licensee shall advertise in such a manner as to lead the public 27 to believe that the licensee is engaged in the practice of any 28 other profession than the one which the licensee is licensed 29 to practice. 30 b. Any advertisement for services provided by a person 31 licensed to practice a profession under this subtitle shall 32 clearly identify the license held by the person advertising or 33 providing services, consistent with this subtitle. 34 2. H.F. _____ profession identified under section 147.74, subsection 2, to do 1 the following when directly engaging a member of the public in 2 the practice of the person’s profession: 3 a. Wear a form of identification consistent with rules 4 promulgated by each applicable board, unless wearing 5 identification creates a safety or health risk. The rules 6 shall establish uniform minimum standards for identification. 7 Minimum standards shall include prominent display of the 8 professional title and abbreviation of the licensee as set 9 forth in section 147.74. 10 b. If wearing identification creates a safety or health 11 risk, the licensee shall verbally disclose the license the 12 licensee holds. 13 3. Persons licensed pursuant to section 148.5 shall also 14 comply with the requirements of subsection 2 of this section 15 consistent with rules adopted by the board of medicine. 16 4. Failure of a licensee to comply with the requirements 17 set forth in subsection 2 and the rules adopted thereunder may 18 constitute a basis for board action against the licensee. 19 Sec. 3. Section 147.74, subsection 21, Code 2013, is amended 20 to read as follows: 21 21. An advanced registered nurse practitioner licensed 22 under chapter 152 may use the words “advanced registered nurse 23 practitioner” or the letters “A.R.N.P.” after the person’s 24 name. A registered nurse licensed under chapter 152 may use 25 the words “registered nurse” or the letters “R. N.” after the 26 person’s name. A licensed practical nurse licensed under 27 chapter 152 may use the words “licensed practical nurse” or the 28 letters “L. P. N.” after the person’s name. 29 EXPLANATION 30 This bill makes changes relating to licensure identification 31 and display and to professional title and abbreviation 32 restrictions for certain health-related professions. 33 The bill requires that any advertisement for services 34 provided by a person licensed in a health-related profession 35 -2- LSB 1623YC (2) 85 jr/sc 2/ 3
H.F. _____ clearly identify the license held by the person advertising or 1 providing services. 2 The bill requires persons licensed in health-related 3 professions whose professional title and abbreviation 4 is designated by Code section 147.74 to wear a form of 5 identification based on standards adopted by each applicable 6 licensing board. The bill also provides that this requirement 7 applies to resident physicians licensed under Code section 8 148.5. 9 The bill also authorizes an advanced registered nurse 10 practitioner to use the words “advanced registered nurse 11 practitioner” or the acronym “A.R.N.P.”. Current law provides 12 that a person who fails to properly use the designations 13 specified in statute is guilty of a simple misdemeanor. A 14 simple misdemeanor is punishable by confinement for no more 15 than 30 days or a fine of at least $65 but not more than $625 16 or both. 17 -3- LSB 1623YC (2) 85 jr/sc 3/ 3
