H.F. _____ Section 1. MOTORCYCLE RIDER TESTING. 1 1. Notwithstanding 761 IAC 604.31(2), the department of 2 transportation shall not waive the off-street motorcycle skill 3 test requirement for an applicant for a class M driver’s 4 license or a motorcycle endorsement. 5 2. The department shall initiate rulemaking to amend 761 IAC 6 604.31 to eliminate the off-street motorcycle skill test from 7 the list of driving tests that may be waived for an applicant 8 for a class M driver’s license or a motorcycle endorsement. 9 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 10 immediate importance, takes effect upon enactment. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 Under current law, an applicant for a class M driver’s 15 license or a motorcycle endorsement on another driver’s 16 license is required to take a driving test that consists 17 of two parts: an off-street motorcycle skill test and an 18 on-street driving test. The department of transportation is 19 authorized to waive one or both components of the driving 20 test for certain applicants, including applicants who have 21 successfully completed the appropriate driver education course 22 and Iowa-approved motorcycle rider education course. This bill 23 prohibits the department from waiving the off-street motorcycle 24 skill test requirement, and the bill requires the department 25 to initiate rulemaking to remove waiver of the off-street 26 motorcycle skill test requirement from its administrative 27 rules. 28 The bill is effective upon enactment. 29 -1- LSB 6165HC (2) 85 dea/nh 1/ 1
