S.F. _____ H.F. _____ Section 1. Section 483A.24, subsection 6, Code 2013, is 1 amended to read as follows: 2 6. a. A fishing license shall not be required of minor 3 pupils of the state school for the blind, state school for 4 the deaf, or of minor residents of other state institutions 5 under the control of an administrator of a division of the 6 department of human services. In addition, a person who is 7 on active duty with the armed forces of the United States, 8 on authorized leave from a duty station located outside of 9 this state, and a resident of the state of Iowa shall not be 10 required to have a license to hunt or fish in this state. The 11 military person shall carry the person’s leave papers and a 12 copy of the person’s current earnings statement showing a 13 deduction for Iowa income taxes while hunting or fishing. In 14 lieu of carrying the person’s earnings statement, the military 15 person may also claim residency if the person is registered to 16 vote in this state. If a deer or wild turkey is taken, the 17 military person shall immediately contact a state conservation 18 officer to obtain an appropriate tag to transport the animal. 19 A fishing license shall not be required of residents of county 20 care facilities or any person who is receiving supplementary 21 assistance under chapter 249 . 22 b. A person who is on active duty with the armed forces 23 of the United States and lives in this state, and who is a 24 nonresident, may apply to purchase any hunting, fishing, or 25 trapping license, or pay any fees, at the same price as a 26 person who is a resident of Iowa. The commission shall, by 27 rule, establish the requirements for issuance of a hunting, 28 fishing, or trapping license, and for the payment of fees, 29 pursuant to this paragraph and provide for an application to be 30 used by an applicant requesting a license or paying a fee under 31 this paragraph. 32 Sec. 2. Section 483A.27, subsections 1 and 2, Code 2013, are 33 amended to read as follows: 34 1. a. A person born after January 1, 1972, shall not 35 -1- LSB 1296DP (8) 85 av/nh 1/ 3

S.F. _____ H.F. _____ obtain a hunting license unless the person has satisfactorily 1 completed a hunter safety and ethics education course approved 2 by the commission. A person who is eleven years of age or more 3 may enroll in an approved hunter safety and ethics education 4 course, but a person who is eleven years of age and who has 5 successfully completed the course shall be issued a certificate 6 of completion which becomes valid on the person’s twelfth 7 birthday. A certificate of completion from an approved hunter 8 safety and ethics education course issued in this state, or a 9 certificate issued by another state, country, or province for 10 completion of a course that meets the standards adopted by the 11 international hunter education association, is valid for the 12 requirements of this section . 13 b. Notwithstanding paragraph “a” , the requirement that 14 a person must have a certificate of completion of a hunter 15 safety and ethics education course in order to obtain a hunting 16 license is waived for a person who is on active duty with the 17 armed forces of the United States or for a person who served on 18 active duty with the armed forces of the United States and was 19 honorably discharged. 20 2. a. A certificate of completion shall not be issued 21 to a person who has not satisfactorily completed a minimum 22 of ten hours of training in an approved hunter safety and 23 ethics education course. The department shall establish the 24 curriculum for the first ten hours of an approved hunter 25 safety and ethics education course offered in this state. 26 Upon completion of the ten-hour curriculum, each person shall 27 pass an individual oral test or a written test provided by 28 the department. The department shall establish the criteria 29 for successfully passing the tests. Based on the results of 30 the test and demonstrated safe handling of a firearm, the 31 instructor shall determine the persons who shall be issued a 32 certificate of completion. 33 b. Notwithstanding paragraph “a” , a resident who is eighteen 34 years of age or older may obtain a certificate of completion 35 -2- LSB 1296DP (8) 85 av/nh 2/ 3

S.F. _____ H.F. _____ without demonstrating the safe handling of a firearm. 1 EXPLANATION 2 This bill relates to certain license requirements under the 3 purview of the natural resource commission. 4 Code section 483A.24(6) is amended to provide that certain 5 minor pupils at state institutions, residents of county care 6 facilities, and persons receiving supplementary assistance 7 under Code chapter 249 do not need a license to fish in this 8 state. In addition, a person who is on active duty with the 9 armed forces of the United States and lives in this state, 10 but is a nonresident, may purchase any hunting, fishing, 11 or trapping license, or pay any fees, at the same price as 12 a person who is a resident of Iowa. The natural resource 13 commission shall, by rule, establish the requirements for 14 licenses issued and fees paid pursuant to the bill and provide 15 for an application to be used when requesting such a license or 16 paying a fee. 17 Code section 483A.27 is amended to provide that a person who 18 is on active duty with the armed forces of the United States, 19 or who served on active duty with the armed forces of the 20 United States and was honorably discharged, is not required to 21 complete a hunter safety and ethics education course in order 22 to obtain a hunting license. In addition, a resident who is 18 23 years of age or older may obtain a certificate of completion 24 of the course without demonstrating the safe handling of a 25 firearm. 26 -3- LSB 1296DP (8) 85 av/nh 3/ 3
