NEW
SECTION
.
80.55
Crime
stopper
surcharge
fund.
1
1.
A
crime
stopper
surcharge
fund
is
created
in
the
office
2
of
the
treasurer
of
state
under
the
control
of
the
department
3
of
public
safety.
Any
moneys
annually
appropriated,
granted,
4
or
credited
to
the
fund,
including
any
federal
moneys,
are
5
appropriated
to
the
department
of
public
safety
for
use
by
6
crime
stopper
programs
throughout
the
state
or
other
programs
7
with
a
similar
dedicated
purpose.

2.
Notwithstanding
section
12C.7,
subsection
2,
interest
9
and
earnings
on
moneys
deposited
in
the
fund
shall
be
credited
10
to
the
fund.
Notwithstanding
section
8.33,
moneys
remaining
11
in
the
fund
at
the
end
of
the
fiscal
year
shall
not
revert
to
12
any
other
fund
but
shall
remain
available
to
be
used
for
the
13
purposes
specified
in
subsection
1.

Sec.
2.
Section
356.7,
subsection
1,
Code
2014,
is
amended
15
to
read
as
follows:
16
1.
a.
The
county
sheriff,
or
a
municipality
operating
a
17
temporary
municipal
holding
facility
or
jail,
may
charge
a
18
prisoner
who
is
eighteen
years
of
age
or
older
and
who
has
been
19
convicted
of
a
criminal
offense
or
sentenced
for
contempt
of
20
court
for
violation
of
a
domestic
abuse
order
for
all
of
the
21
actual
following:
22
(1)
Actual
administrative
costs
relating
to
the
arrest
and
23
booking
of
that
prisoner
,
for
room
.
24
(2)
Room
and
board
provided
to
the
prisoner
while
in
the
25
custody
of
the
county
sheriff
or
municipality
,
and
for
any
plus
26
a
crime
stopper
surcharge
equal
to
one
percent
of
the
total
27
charged
for
room
and
board
if
a
crime
stopper
program
exists
28
in
the
county
or
municipality.

Any
medical
aid
provided
to
the
prisoner
under
section
30
356.5
.
Moneys

b.
(1)
Except
as
provided
in
subparagraph
(2),
moneys

collected
by
the
sheriff
or
municipality
under
this
section

shall
be
credited
respectively
to
the
county
general
fund
or
34
the
city
general
fund
and
distributed
as
provided
in
this

Moneys
collected
from
the
crime
stopper
surcharge
shall

be
remitted
by
the
county
or
municipality
to
the
crime
stopper
3
surcharge
fund
created
in
section
80.55.

c.
If
a
prisoner
who
has
been
convicted
of
a
criminal
5
offense
or
sentenced
for
contempt
of
court
for
violation
of
6
a
domestic
abuse
order
fails
to
pay
for
the
administrative
7
costs,
the
room
and
board,
crime
stopper
surcharge
if
8
applicable,
or
medical
aid,
the
sheriff
or
municipality
9
may
file
a
reimbursement
claim
with
the
district
court
as
10
provided
in
subsection
2
.
The
county
attorney
may
file
the
11
reimbursement
claim
on
behalf
of
the
sheriff
and
the
county
12
or
the
municipality.
The
attorney
for
the
municipality
may
13
also
file
a
reimbursement
claim
on
behalf
of
the
municipality.

This
section
does
not
apply
to
prisoners
who
are
paying
for
15
their
room
and
board
by
court
order
pursuant
to
sections
356.26

through
356.35
.

EXPLANATION
18
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
establishes
a
crime
stopper
surcharge,
creates
a
21
crime
stopper
fund,
and
makes
appropriations.
22
Current
law
allows
a
county
or
municipality
operating
a
23
jail
to
charge
an
inmate
18
years
of
age
or
older
for
the
24
administrative
costs,
room
and
board,
and
medical
costs
while
25
incarcerated
at
the
jail.
26
In
addition
to
the
aforementioned
costs,
the
bill
allows
a
27
county
or
municipality
operating
a
jail
to
charge
an
inmate
a
28
crime
stopper
surcharge
equal
to
1
percent
of
the
total
charged
29
for
room
and
board
if
a
crime
stopper
program
exists
in
the
30
county
or
municipality
where
the
inmate
is
incarcerated.

The
bill
requires
the
county
or
municipality
to
remit
the
32
crime
stopper
surcharge
to
the
crime
stopper
surcharge
fund
33
created
in
new
Code
section
80.55.

The
bill
establishes
the
crime
stopper
surcharge
in
the

of
the

of
state
under
the

that

the
fund
