to
read
as
follows:

Notwithstanding
subsection

,
for
the
fiscal
years
beginning

2013,
and
July
1,
2014,
and
July
1,
2015,
county

revenues
from
taxes
levied
by
the
county
and
credited
to
5
the
county
services
fund
shall
not
exceed
the
lower
of
the
6
following
amounts:

are

amended
to
read
as
follows:

1.
For
the
fiscal
years
beginning
July
1,
2013,
and
July
1,

2014,
and
July
1,
2015,
the
state
and
county
funding
for
the
11
mental
health
and
disability
services
administered
or
paid
for
12
by
counties
shall
be
provided
based
on
a
statewide
per
capita
13
expenditure
target
amount
computed
in
accordance
with
this
14
section
and
section
334.424A
.

4.
a.
For
the
fiscal
years
beginning
July
1,
2013,
16
and
July
1,
2014,
and
July
1,
2015,
a
county
with
a
county
17
population
expenditure
target
amount
that
exceeds
the
amount
18
of
the
county’s
base
year
expenditures
for
mental
health
and
19
disabilities
services
shall
receive
an
equalization
payment
for
20
the
difference.

b.
The
equalization
payments
determined
in
accordance
22
with
this
subsection
shall
be
made
by
the
department
of
human
23
services
for
each
fiscal
year
as
provided
in
appropriations
24
made
from
the
property
tax
relief
fund
for
this
purpose.
If
25
the
county
is
part
of
a
region
that
has
been
approved
by
the
26
department
in
accordance
with
section
331.389
,
to
commence
27
partial
or
full
operations,
the
county’s
equalization
payment
28
shall
be
remitted
to
the
region
or
the
county,
as
appropriate,
29
for
expenditure
as
approved
by
the
region’s
governing
board
or
30
in
accordance
with
the
county’s
service
management
plan,
as
31
appropriate.
The
payment
for
a
county
that
has
been
approved
32
by
the
department
to
operate
as
an
individual
county
region
33
shall
be
remitted
to
the
county
for
expenditure
as
approved
by
34
the
county
board
of
supervisors.
For
the
fiscal
year
beginning

and
succeeding
fiscal
years,
the
payment
shall
1
be
remitted
on
or
before
December
31
only
for
those
counties
2
approved
to
operate
as
an
individual
county
region
or
to
be

part
of
a
region.
Remittance
of
the
payment
for
a
county
4
without
such
approval
shall
be
deferred
until
such
approval
is
5
granted.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
extends
the
duration
of
county
mental
health
and
10
disabilities
services
fund
per
capita
levy
and
equalization
11
provisions.

Code
section
331.424A,
relating
to
the
county
mental
health
13
and
disability
services
funds
and
levies,
is
amended.
The
14
requirement
for
counties
to
levy
using
a
$47.28
base
per
capita
15
amount
or
the
county’s
base
year
expenditures,
whichever
dollar
16
amount
is
less,
applies
only
for
FY
2013-2014
and
FY
2014-2015.
17
The
bill
extends
this
requirement
through
FY
2015-2016.
18
Code
section
426B.3,
relating
to
per
capita
funding
for
19
county
services
funds,
is
amended.
The
bill
extends
the
$47.28
20
per
capita
levy
provisions
and
the
requirement
for
the
state
21
to
provide
equalization
payments
to
counties
restricted
from
22
levying
the
full
per
capita
amount
to
continue
through
FY
23
2015-2016.
