H.F. _____ Section 1. NEW SECTION . 148.15 Interventional pain 1 procedures. 2 1. A person shall not practice or offer to practice 3 interventional pain procedures unless such person meets all of 4 the following requirements: 5 a. The person is a physician licensed under this chapter. 6 b. The person has completed medical training in an 7 allopathic or osteopathic medical college. 8 c. The person has completed postgraduate medical training 9 with formal education in the medical practice of interventional 10 pain procedures which has been approved by the board. 11 2. For the purposes of this section, “interventional pain 12 procedures” means any of the following procedures used in 13 the course of diagnosing or treating pain which is chronic, 14 persistent, and intractable, or which occurs outside of a 15 surgical, obstetrical, or postoperative course of care: 16 a. Ablation of targeted nerves. 17 b. Percutaneous precision needle placement within the spinal 18 column with placement of drugs, such as local anesthetics, 19 steroids, and analgesics, under fluoroscopic guidance. 20 c. Laser or endoscopic discectomy, or the surgical placement 21 of intrathecal infusion pumps or spinal cord stimulators. 22 3. Nothing in this section shall be construed to prohibit 23 or restrict the performance of surgical or obstetrical 24 anesthesia services or postoperative pain control by an 25 advanced registered nurse practitioner licensed in the state 26 and holding a specialty, as determined by the board of nursing, 27 as a certified registered nurse anesthetist. 28 4. Notwithstanding subsection 1, a podiatrist licensed 29 under chapter 149 or a dentist licensed under chapter 153 may 30 perform interventional pain procedures within the scope of 31 the person’s license in accordance with standards of care as 32 determined by the respective licensing boards. 33 5. A person who violates this section is guilty of a serious 34 misdemeanor as provided in section 147.86 and is subject to the 35 -1- LSB 1547YC (2) 85 ad/nh 1/ 2
H.F. _____ injunction, punishment, and enforcement provisions set forth 1 in chapter 147. 2 6. The board may adopt rules to implement the provisions of 3 this section. 4 EXPLANATION 5 This bill establishes requirements for a person who 6 practices certain chronic interventional pain procedures. The 7 bill lists the chronic interventional pain procedures. The 8 bill provides that in order to perform the listed procedures a 9 person must be a licensed physician who has completed medical 10 training in an allopathic or osteopathic medical college 11 and has completed postgraduate medical training with formal 12 education in the medical practice of interventional pain 13 procedures. 14 The bill exempts certain licensed professionals from the 15 professional requirements in certain circumstances. The bill 16 does not restrict an advanced registered nurse practitioner 17 with a specialty as a certified registered nurse anesthetist 18 from performing surgical or obstetrical anesthesia services or 19 postoperative pain control. The bill also exempts licensed 20 podiatrists and dentists performing procedures within the scope 21 of their license and in accordance with applicable standards 22 of care. 23 The bill provides that the board of medicine shall adopt 24 rules to implement the bill. 25 The bill makes a penalty in Code section 147.86 applicable, 26 making it a serious misdemeanor to violate any of the 27 provisions of the bill. 28 -2- LSB 1547YC (2) 85 ad/nh 2/ 2
