S.F. _____ H.F. _____ Section 1. Section 8A.504, subsection 2, paragraph j, Code 1 2013, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (4) The collection entity shall remit 3 to the state court administrator, on at least a monthly basis, 4 ten percent of the amounts set off to be used by the judicial 5 branch to defray the costs of collecting unpaid court debt 6 pursuant to section 602.8107. 7 Sec. 2. Section 602.3106, subsection 2, Code 2013, is 8 amended by striking the subsection and inserting in lieu 9 thereof the following: 10 2. The fees collected are appropriated to the judicial 11 branch and shall be used to offset the expenses of the board, 12 including the costs of administering the examination. 13 Sec. 3. Section 602.8106, subsection 1, paragraph c, Code 14 2013, is amended to read as follows: 15 c. For filing and docketing a complaint or information or 16 uniform citation and complaint for parking violations under 17 sections 321.236 , 321.239 , 321.358 , 321.360 , and 321.361 , eight 18 dollars, effective January 1, 2004 thirty-five dollars . The 19 court costs in cases of parking meter and overtime parking 20 violations which are contested, and charged and collected 21 pursuant to section 321.236, subsection 1 , or pursuant to 22 a uniform citation and complaint, are eight dollars per 23 information or complaint or per uniform citation and complaint 24 effective January 1, 1991. 25 Sec. 4. Section 602.10108, subsection 2, Code 2013, is 26 amended to read as follows: 27 2. Fees shall be collected by the board and transmitted 28 to the treasurer of state who shall deposit the fees in the 29 general fund of the state are appropriated to the judicial 30 branch and shall be used to offset the costs of administering 31 this article . 32 EXPLANATION 33 This bill relates to the administration of the judicial 34 branch. 35 -1- LSB 1163XD (2) 85 jm/rj 1/ 2
S.F. _____ H.F. _____ The bill requires the department of administrative 1 services and any other state agency that maintains a separate 2 accounting system and elects to establish a debt collection 3 setoff procedure, to remit to the state court administrator, 4 10 percent of the amounts set off from the collection of 5 delinquent court debt for use by the judicial branch to defray 6 the costs of collecting unpaid court debt. 7 The bill specifies that the fees assessed for shorthand 8 certification examinations are appropriated to the judicial 9 branch and shall be used to offset the expenses of the board 10 of examiners of shorthand reporters, including the costs of 11 administering examinations. 12 The bill increases the fee for filing and docketing a 13 complaint or information for state and local parking violations 14 from $8 to $35. The bill eliminates the court costs assessed 15 for contested local parking meter and overtime parking 16 violations. 17 The bill specifies that the fees collected for examination 18 and admission to practice law are appropriated to the judicial 19 branch and shall be used to offset the costs of administering 20 the examination and admission process to practice law. 21 -2- LSB 1163XD (2) 85 jm/rj 2/ 2
