Section 476.42, subsection 1, Code 2013, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0a. “Aggregate net metering” means deducting 3 or offsetting electricity produced by an alternate energy 4 production facility against the electricity which would 5 otherwise be purchased from an electric utility as measured on 6 more than one utility meter. 7 Sec. 2. NEW SECTION . 476.49 Agricultural aggregate net 8 metering. 9 1. An electric utility customer who is an authorized farm 10 corporation, authorized limited liability company, authorized 11 trust, family farm corporation, family farm limited liability 12 company, family farm limited partnership, or family trust, as 13 defined in section 9H.1, may engage in aggregate net metering 14 with regard to the electricity produced by an alternate 15 energy production facility of up to five hundred kilowatts of 16 nameplate generating capacity owned by the customer against the 17 aggregate electricity purchased from the electric utility in a 18 given month as measured on all meters used by that customer on 19 a single parcel of land or on contiguous parcels of land. 20 2. An electric utility customer engaging in aggregate 21 net metering pursuant to subsection 1 shall not sell any 22 electricity, gas, or useful thermal energy produced by the 23 alternate energy production facility and not used by the 24 customer to any other utility customer. The customer may, 25 however, enter into a power purchase agreement with an electric 26 utility with regard to excess electricity produced at rates 27 determined pursuant to section 476.43. Notwithstanding the 28 maximum purchase provisions of section 476.44, an electric 29 utility shall enter into a power purchase agreement with a 30 customer meeting the requirements of this section and shall 31 otherwise facilitate aggregate net metering as provided in this 32 section. 33 EXPLANATION 34 This bill authorizes specified agricultural electric 35 -1- LSB 1853YC (2) 85 rn/nh 1/ 2

The 1 bill defines “aggregate net metering” to mean deducting 2 or offsetting electricity produced by an alternate energy 3 production facility against the electricity which would 4 otherwise be purchased from an electric utility as measured on 5 more than one utility meter. 6 The bill provides that an electric utility customer who is 7 an authorized farm corporation, authorized limited liability 8 company, authorized trust, family farm corporation, family farm 9 limited liability company, family farm limited partnership, 10 or family trust, as defined in Code section 9H.1, may engage 11 in aggregate net metering with regard to the electricity 12 produced by an alternate energy production facility of up to 13 500 kilowatts of nameplate generating capacity owned by the 14 customer against the aggregate electricity purchased from 15 the electric utility in a given month as measured on all 16 meters used by that customer on a single parcel of land or on 17 contiguous parcels of land. The bill prohibits the customer 18 from selling any electricity, gas, or useful thermal energy 19 produced by the alternate energy production facility and not 20 used by the customer to any other utility customer. The bill 21 states that the customer may enter into a power purchase 22 agreement with an electric utility with regard to excess 23 electricity produced at rates determined pursuant to Code 24 section 476.43.
