136C.3,
subsection
10,
Code
2013,
is
1
amended
to
read
as
follows:

10.
a.
Adopt
rules
specifying
the
minimum
training
and

performance
standards
for
an
individual
using
a
radiation
4
machine
for
mammography,
and
other
rules
necessary
to
5
implement
section
136C.15
.
The
rules
shall
complement
federal
6
requirements
applicable
to
similar
radiation
machinery
and
7
shall
not
be
less
stringent
than
those
federal
requirements.

(1)
Adopt
rules
to
require
that,
by
January
1,
2014,
9
a
facility
where
mammography
services
are
performed
shall
10
include
information
on
breast
density
in
mammogram
reports
sent
11
to
patients
pursuant
to
regulations
implementing
the
federal
12
Mammography
Quality
Standards
Act
of
1992,
Pub.
L.
No.
102-539,
13
as
amended,
and
include
in
the
report
sent
to
a
patient
who
14
has
dense
breast
tissue,
as
determined
by
the
interpreting
15
physician
based
on
standards
promulgated
by
the
American
16
college
of
radiology,
a
notice
that
contains
the
following
17
language:

Your
mammogram
demonstrates
that
you
may
have
dense
breast
19
tissue,
which
can
hide
cancer
or
other
abnormalities.
A
20
report
of
your
mammography
results,
which
contains
information
21
about
your
breast
density,
has
been
sent
to
your
referring
22
physician’s
office,
and
you
should
contact
your
physician
if
23
you
have
any
questions
or
concerns
about
this
report.

Nothing
in
this
lettered
paragraph
“b”
shall
be
25
construed
to
create
or
impose
liability
on
a
facility
where
26
mammography
services
are
performed
beyond
the
duty
to
provide
27
notice
as
set
forth
in
this
lettered
paragraph
“b”
.

(3)
Nothing
in
this
lettered
paragraph
“b”
shall
be
deemed
29
to
require
a
notice
that
is
inconsistent
with
the
provisions

of
the
federal
Mammography
Quality
Standards
Act
of
1992,
Pub.

as
amended,
or
any
regulations
promulgated

that
Act.

EXPLANATION

This
bill
establishes
a
notification
requirement
for

mammogram
reports.
The
bill
directs
the
department
of
public
1
health
to
adopt
rules
that
require
a
facility
performing
2
mammography
services
to
include
information
on
breast
density
3
in
mammogram
reports
that
are
sent
to
patients
pursuant
to
4
federal
law
and
rules.
If
a
patient
has
dense
breast
tissue,
5
as
determined
by
the
standards
of
the
American
college
of
6
radiology,
the
facility
providing
mammography
services
must
7
send
a
notice
containing
the
language
provided
in
the
bill.
8
The
notice
informs
the
patient
that
the
mammogram
demonstrates
9
the
patient
may
have
dense
breast
tissue
which
can
hide
cancer
10
or
other
abnormalities
and
directs
the
patient
to
contact
the
11
physician
with
further
questions
or
concerns.

The
bill
states
that
it
does
not
impose
liability
on
the
13
facility
performing
mammography
services
beyond
the
duty
to
14
provide
the
breast
density
notice.
15
The
facility
providing
mammography
services
must
comply
with
16
the
notice
requirement
by
January
1,
2014.
