H.F. 87 Section 1. Section 28E.5, Code 2013, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 5A. For an agreement entered into with a 3 political subdivision of this state on or after July 1, 2013, 4 that the parties agree to submit controversies arising under 5 the agreement to mediation, conducted pursuant to chapter 679C, 6 and, if unresolved, to arbitration, conducted pursuant to 7 chapter 679A. This subsection shall not apply to agreements 8 entered into under this chapter with any public agency of any 9 other state or the United States or to agreements between 10 administrative departments, commissions, or boards of the state 11 government as contemplated in section 679A.19. 12 EXPLANATION 13 This bill requires that intergovernmental agreements 14 entered into pursuant to Code chapter 28E with a political 15 subdivision include a provision that the parties agree to 16 submit controversies arising under the agreement to mediation, 17 and, if unresolved, to arbitration. The requirements of the 18 bill shall not apply to 28E agreements with any public agency 19 of any other state or the United States or to agreements 20 between administrative departments, commissions, or boards of 21 the state government. 22 -1- LSB 1027HH (3) 85 aw/sc 1/ 1
