H.F. 595 Section 1. Section 260C.14, subsection 14, Code 2013, is 1 amended by adding the following new paragraphs: 2 NEW PARAGRAPH . c. Adopt rules to classify as a resident, 3 for purposes of tuition and mandatory fees, a person who meets 4 the following criteria: 5 (1) Attended an accredited school in this state for at least 6 four consecutive years as of the date the person graduated from 7 an accredited Iowa high school, or was placed under private 8 instruction in accordance with chapter 299A for at least four 9 consecutive years immediately prior to the fiscal year in which 10 the person enrolled in a community college. 11 (2) While a resident of this state in a previous year, 12 was enrolled in, and classified as a resident for purposes of 13 tuition and mandatory fees by, an Iowa community college or an 14 institution of higher learning governed by the state board of 15 regents. 16 NEW PARAGRAPH . d. Adopt rules establishing the criteria 17 and procedures by which a person demonstrates residency for 18 purposes of tuition and mandatory fees. 19 Sec. 2. Section 262.9, subsection 17, Code 2013, is amended 20 by adding the following new paragraphs: 21 NEW PARAGRAPH . c. Adopt rules to classify as a resident, 22 for purposes of undergraduate and graduate tuition and 23 mandatory fees, a person who meets the following criteria: 24 (1) Attended an accredited school in this state for at least 25 four consecutive years as of the date the person graduated from 26 an accredited Iowa high school, or was placed under private 27 instruction in accordance with chapter 299A for at least four 28 consecutive years immediately prior to the fiscal year in 29 which the person enrolled in an institution of higher learning 30 governed by the state board. 31 (2) While a resident of this state in a previous year, 32 was enrolled in, and classified as a resident for purposes of 33 tuition and mandatory fees by, an Iowa community college or an 34 institution of higher learning governed by the state board. 35 -1- LSB 2309HV (2) 85 kh/sc 1/ 2

Adopt rules establishing the criteria 1 and procedures by which a person demonstrates residency for 2 purposes of tuition and mandatory fees. 3 EXPLANATION 4 This bill requires community colleges and the state board 5 of regents to classify as a resident for purposes of tuition 6 and mandatory fees a person who either attended an accredited 7 school in this state for at least four consecutive years as 8 of the date the person graduated from an accredited Iowa high 9 school or was placed under private instruction in accordance 10 with Code chapter 299A for at least four years prior to 11 the fiscal year in which the person enrolled in a public 12 postsecondary education institution, and, while a resident of 13 this state in a previous year, was enrolled in, and classified 14 as a resident for purposes of tuition and mandatory fees by, 15 an Iowa community college or an institution of higher learning 16 governed by the state board of regents. 17 The bill also requires the community colleges and the state 18 board of regents to adopt rules establishing the criteria 19 and procedures by which a person demonstrates residency for 20 purposes of tuition and mandatory fees. 21 -2- LSB 2309HV (2) 85 kh/sc 2/ 2
