H.F. 540 Section 1. NEW SECTION . 137G.1 Food vendor —— motor vehicle 1 —— background check. 2 1. A business that operates a motor vehicle primarily 3 marketing the sale and dispensing of ice cream or other food 4 products from or near the motor vehicle to children may require 5 an applicant for employment or employee of the business to 6 be subject to a criminal history and abuse registry record 7 background check. The business shall perform the background 8 check by accessing the single contact repository established 9 under section 135C.33, subsection 6. 10 2. The business shall inform the applicant or employee 11 of the requirement of the background check required under 12 subsection 1 and obtain a signed waiver from the applicant or 13 employee prior to requesting such a check. 14 Sec. 2. Section 235A.15, subsection 2, paragraph e, Code 15 2013, is amended by adding the following new subparagraph: 16 NEW SUBPARAGRAPH . (24) To a business which is authorized to 17 perform a background check pursuant to section 137G.1. 18 Sec. 3. Section 235B.6, subsection 2, paragraph e, Code 19 2013, is amended by adding the following new subparagraph: 20 NEW SUBPARAGRAPH . (19) To a business which is authorized to 21 perform a background check pursuant to section 137G.1. 22 EXPLANATION 23 This bill relates to criminal history and abuse registry 24 record checks for certain food vendors. 25 The bill provides that a business that operates a motor 26 vehicle primarily marketing the sale and dispensing of ice 27 cream or other food products from or near the motor vehicle 28 to children may require an applicant for employment or an 29 employee of the business to undergo a criminal history and 30 abuse registry record check by the business. 31 The bill requires the business to inform the applicant for 32 employment or employee of the background check and obtain a 33 signed waiver prior to requesting a check. 34 The bill also requires a business that chooses to perform a 35 -1- LSB 1710HV (2) 85 jm/nh 1/ 2
