H.F. 54 Section 1. Section 155A.13A, subsection 3, Code 2013, is 1 amended to read as follows: 2 3. Discipline. The board may deny, suspend, or revoke a 3 nonresident pharmacy license for any violation of this section , 4 section 155A.15, subsection 2 , paragraph “a” , “b” , “d” , “e” , 5 “f” , “g” , “h” , or “i” , or “j” , chapter 124 , 124A , 124B , 126 , or 6 205 , or a rule of the board. 7 Sec. 2. Section 155A.15, subsection 2, Code 2013, is amended 8 by adding the following new paragraph: 9 NEW PARAGRAPH . j. Violated a provision of sections 261 10 through 264 of the federal Health Insurance Portability and 11 Accountability Act of 1996, Pub. L. No. 104-191, or that any 12 owner or employee of the pharmacy violated such a provision. 13 EXPLANATION 14 This bill provides that the board of pharmacy may refuse to 15 issue or renew a pharmacy license, or may impose a fine, issue 16 a reprimand, or revoke, restrict, cancel, or suspend a license, 17 and may place a licensee on probation, if the board finds that 18 the applicant or licensee has violated the privacy requirements 19 of the federal Health Insurance Portability and Accountability 20 Act. 21 -1- LSB 1183YH (3) 85 jr/nh 1/ 1
