H.F. 461 Section 1. NEW SECTION . 135.30 Commotio cordis policies. 1 1. Annually, a private youth sports league shall provide 2 information on commotio cordis to coaches, children, and the 3 parents and guardians of children participating in high-risk 4 sports prior to the beginning of seasonal athletic practices 5 or competitions. Such information shall include all of the 6 following: 7 a. The most common causes of commotio cordis. 8 b. Appropriate actions to take in response to a suspected 9 commotio cordis episode. 10 c. Instructions for reporting commotio cordis episodes to 11 the national commotio cordis registry. 12 2. a. A private youth sports league shall develop and 13 maintain a commotio cordis emergency action plan that outlines 14 core expectations for evaluation and emergency management of 15 suspected episodes of commotio cordis in children participating 16 in high-risk sports. 17 b. A private youth sports league shall maintain at all 18 times at least one coach or other staff member or volunteer 19 who is aware of the commotio cordis emergency action plan and 20 knowledgeable in implementation of the plan. Each private 21 youth sports league shall ensure that at least one such person 22 is present at each athletic practice or competition for a 23 high-risk sport. 24 3. A private youth sports league shall report each 25 documented episode of commotio cordis to the national commotio 26 cordis registry and shall designate a person responsible for 27 such reporting. 28 4. a. A private youth sports league which acquires or uses 29 a defibrillator for the treatment of suspected commotio cordis 30 episodes shall incur no liability for such action. 31 b. Except as provided in paragraph “a” , this section does 32 not create or affect liability, or immunity therefrom, for any 33 person. 34 5. H.F. 461 a. “Commotio cordis” means cardiac arrhythmia occurring as a 1 result of a sudden blow to the chest. 2 b. “High-risk sports” means baseball, softball, lacrosse, 3 soccer, ice hockey, martial arts, and other sports in which 4 there is a high risk of commotio cordis episodes. 5 c. “Private youth sports league” means a nonscholastic 6 organized group formed for the purpose of cross-team athletic 7 competition among persons under nineteen years of age that 8 charges a fee as a condition of participation. 9 Sec. 2. NEW SECTION . 280.13D Commotio cordis policies. 10 1. Annually, a school district or nonpublic school shall 11 provide information on commotio cordis to coaches, children, 12 and the parents and guardians of children participating in 13 high-risk sports prior to the beginning of seasonal athletic 14 practices or competitions. Such information shall include all 15 of the following: 16 a. The most common causes of commotio cordis. 17 b. Appropriate actions to take in response to a suspected 18 commotio cordis episode. 19 c. STATE MANDATE FUNDING SPECIFIED. In accordance 15 with section 25B.2, subsection 3, the state cost of requiring 16 compliance with any state mandate included in this Act shall 17 be paid by a school district from state school foundation aid 18 received by the school district under section 257.16. This 19 specification of the payment of the state cost shall be deemed 20 to meet all of the state funding-related requirements of 21 section 25B.2, subsection 3, and no additional state funding 22 shall be necessary for the full implementation of this Act 23 by and enforcement of this Act against all affected school 24 districts. 25 EXPLANATION 26 This bill requires a school district, nonpublic school, or 27 private youth sports league to annually provide information 28 on commotio cordis to coaches, children, and the parents 29 and guardians of children participating in high-risk sports 30 prior to the beginning of seasonal athletic practices or 31 competitions. The information is to include the most common 32 causes of commotio cordis, appropriate actions to take 33 in response to a suspected commotio cordis episode, and 34 instructions for reporting commotio cordis episodes to the 35 -3- LSB 2446YH (7) 85 je/nh 3/ 5
H.F. 461 national commotio cordis registry. 1 The bill defines “commotio cordis” as cardiac arrhythmia 2 occurring as a result of a sudden blow to the chest. The 3 bill defines “private youth sports league” as a nonscholastic 4 organized group formed for the purpose of cross-team athletic 5 competition among persons under 19 years of age that charges 6 a fee as a condition of participation. The bill defines 7 “high-risk sports” as baseball, softball, lacrosse, soccer, ice 8 hockey, martial arts, and other sports in which there is a high 9 risk of commotio cordis episodes. 10 The bill requires a school district, nonpublic school, or 11 private youth sports league to develop and maintain a commotio 12 cordis emergency action plan. The school district, nonpublic 13 school, or private youth sports league shall maintain at all 14 times at least one coach or other staff member or volunteer who 15 is aware of the plan and knowledgeable in its implementation 16 and shall ensure that at least one such person is present at 17 each athletic practice or competition for a high-risk sport. 18 The bill requires a school district, nonpublic school, or 19 private youth sports league to report each documented episode 20 of commotio cordis to the national commotio cordis registry and 21 to designate a person responsible for such reporting. 22 The bill provides that a school district, nonpublic school, 23 or private youth sports league which acquires or uses a 24 defibrillator for the treatment of suspected commotio cordis 25 episodes shall incur no liability for such action. The bill 26 does not otherwise create or affect liability, or immunity 27 therefrom, for any person. 28 The bill may include a state mandate as defined in Code 29 section 25B.3. The bill requires that the state cost of 30 any state mandate included in the bill be paid by a school 31 district from state school foundation aid received by the 32 school district under Code section 257.16.
