H.F. 459 Section 1. Section 259A.1, Code 2013, is amended to read as 1 follows: 2 259A.1 Tests —— appropriation . 3 1. The department of education shall cause to be made 4 available for qualified individuals a high school equivalency 5 diploma. The diploma shall be issued on the basis of 6 satisfactory competence as shown by tests covering all of the 7 following: reading, arts, language arts, writing, mathematics, 8 science, and social studies. 9 2. There is appropriated from the general fund of the state 10 to the department of education for the fiscal year beginning 11 July 1, 2013, and each succeeding fiscal year, the sum of 12 fifty thousand dollars to be allocated to community colleges 13 as provided in paragraph “a” to assist qualified individuals 14 in paying the costs of tests administered pursuant to this 15 section. 16 a. Allocation of the moneys appropriated pursuant to 17 subsection 1 shall be based upon the proportion that the sum of 18 the tests administered pursuant to this section by a community 19 college for the previous fiscal year bears to the sum of the 20 tests administered pursuant to this section by all of the 21 community colleges in the state for the previous fiscal year, 22 as reported to the department. 23 b. Notwithstanding section 8.33, moneys appropriated in this 24 subsection that remain unencumbered or unobligated at the close 25 of the fiscal year shall not revert but shall remain available 26 for expenditure for the purposes designated until the close 27 of the succeeding fiscal year, and shall not be transferred, 28 used, obligated, appropriated, or otherwise encumbered except 29 as provided in this section. 30 EXPLANATION 31 This bill appropriates $50,000 annually from the general 32 fund of the state to the department of education to be 33 allocated to community colleges to assist qualified individuals 34 in paying the costs of tests administered for purposes of 35 -1- LSB 2356YH (3) 85 kh/sc 1/ 2
H.F. 459 achieving a high school equivalency diploma. 1 Allocation of the moneys appropriated is based upon the 2 proportion that the sum of the high school equivalency tests 3 administered by a community college for the previous fiscal 4 year bears to the sum of the high school equivalency tests 5 administered by all of the community colleges in the state for 6 the previous fiscal year, as reported to the department. 7 Moneys appropriated that remain unencumbered or unobligated 8 at the close of the fiscal year shall not revert but shall 9 remain available for expenditure for the same purpose until 10 the close of the succeeding fiscal year, and shall not be 11 transferred, used, obligated, appropriated, or otherwise 12 encumbered for any other purpose. 13 -2- LSB 2356YH (3) 85 kh/sc 2/ 2
