H.F. 418 Section 1. Section 147.72, Code 2013, is amended to read as 1 follows: 2 147.72 Professional titles and abbreviations. 3 1. a. Any person licensed to practice a profession under 4 this subtitle may append to the person’s name any recognized 5 title or abbreviation, which the person is entitled to use, 6 to designate the person’s particular profession, but no other 7 person shall assume or use such title or abbreviation, and no 8 licensee shall advertise in such a manner as to lead the public 9 to believe that the licensee is engaged in the practice of any 10 other profession than the one which the licensee is licensed 11 to practice. 12 b. Any advertisement for services provided by a person 13 licensed to practice a profession under this subtitle shall 14 clearly identify the license held by the person advertising or 15 providing services, consistent with this subtitle. 16 2. A board shall require any person licensed to practice a 17 profession identified under section 147.74 to do the following 18 when directly engaging a member of the public in a health care 19 clinic or hospital in the practice of the person’s profession: 20 a. Wear a form of identification consistent with rules 21 promulgated by the department in collaboration with each 22 applicable board, unless wearing identification creates a 23 safety or health risk, or in situations when the licensee is 24 voluntarily and gratuitously responding to a need for medical 25 care created by an emergency or a state or local disaster. 26 The rules shall establish uniform minimum standards for 27 identification. Minimum standards shall include prominent 28 display of the professional title and abbreviation of the 29 licensee as set forth in section 147.74. 30 b. If wearing identification creates a safety or health 31 risk, or in situations when the licensee is voluntarily and 32 gratuitously responding to a need for medical care created by 33 an emergency or a state or local disaster, the licensee shall 34 verbally disclose the license the licensee holds. 35 -1- LSB 1623HV (3) 85 jr/sc 1/ 3

Persons licensed pursuant to section 148.5 shall 1 also comply with the requirements of subsection 2 of this 2 section consistent with rules promulgated by the department in 3 collaboration with the board of medicine. 4 4. Failure of a licensee to comply with the requirements 5 set forth in subsection 2 and the rules adopted thereunder may 6 constitute a basis for board action against the licensee. 7 Sec. 2. Section 147.74, subsection 21, Code 2013, is amended 8 to read as follows: 9 21. An advanced registered nurse practitioner practicing 10 pursuant to rules promulgated by the board and licensed as a 11 registered nurse under chapter 152 may use the words “advanced 12 registered nurse practitioner” or the letters “A. R. N. P.” after 13 the person’s name. A registered nurse licensed under chapter 14 152 may use the words “registered nurse” or the letters “R. N.” 15 after the person’s name. A licensed practical nurse licensed 16 under chapter 152 may use the words “licensed practical nurse” 17 or the letters “L. P. N.” after the person’s name. 18 EXPLANATION 19 This bill makes changes relating to licensure identification 20 and display and to professional title and abbreviation 21 restrictions for certain health-related professions. 22 The bill requires that any advertisement for services 23 provided by a person licensed in a health-related profession 24 clearly identify the license held by the person advertising or 25 providing services. 26 The bill requires persons licensed in health-related 27 professions whose professional title and abbreviation 28 is designated by Code section 147.74 to wear a form of 29 identification consistent with rules promulgated by the 30 department of public health, in collaboration with the 31 applicable licensing board, unless wearing the identification 32 creates a safety or health risk or if the person is responding 33 to an emergency or disaster. The bill also provides that this 34 requirement applies to resident physicians licensed under Code 35 -2- LSB 1623HV (3) 85 jr/sc 2/ 3
H.F. 418 section 148.5. 1 The bill also authorizes an advanced registered nurse 2 practitioner to use the words “advanced registered nurse 3 practitioner” or the acronym “A.R.N.P.”. Current law provides 4 that a person who fails to properly use the designations 5 specified in statute is guilty of a simple misdemeanor. A 6 simple misdemeanor is punishable by confinement for no more 7 than 30 days or a fine of at least $65 but not more than $625 8 or both. 9 -3- LSB 1623HV (3) 85 jr/sc 3/ 3
