H.F. 402 Section 1. NEW SECTION . 295.1 Legislative findings and 1 intent. 2 The general assembly finds that it is in the public interest 3 to develop and equitably fund instructional technology within 4 the public schools of this state to ensure that students, 5 teachers, and administrators are equipped and prepared to 6 excel. Toward that goal, it is the intent of this chapter to 7 establish and fund a school improvement technology program. 8 Sec. 2. NEW SECTION . 295.2 School improvement technology 9 appropriation. 10 1. a. There is appropriated from the general fund of 11 the state to the department of education for the fiscal year 12 beginning July 1, 2013, and ending June 30, 2014, the sum 13 of twenty-five million dollars for the school improvement 14 technology program. 15 b. There is appropriated from the general fund of the state 16 to the department of education for the fiscal year beginning 17 July 1, 2014, and ending June 30, 2015, the sum of twenty-five 18 million dollars for the school improvement technology program. 19 2. a. For each fiscal year in which moneys are appropriated 20 for purposes of the program, and after the allocations of 21 moneys pursuant to paragraph “c” and subsection 3, the moneys 22 remaining shall be allocated to school districts and the 23 schools and institutions specified in paragraph “b” in the 24 proportion that the basic enrollment of a district, school, or 25 institution bears to the sum of the basic enrollments of all 26 school districts in the state for the budget year. However, 27 except as provided in paragraph “c” , a district, school, or 28 institution shall not receive less than fifteen thousand 29 dollars in a fiscal year. 30 b. The Iowa braille and sight saving school and the state 31 school for the deaf governed by the state board of regents, and 32 the Glenwood and Woodward state resource centers, the mental 33 health institutes at Cherokee and Independence, the state 34 training school, and the Iowa juvenile home under the control 35 -1- LSB 2183HH (5) 85 kh/sc 1/ 7
H.F. 402 of the department of human services as provided in section 1 218.1, subsections 1 through 3, 5, 7, and 8, shall receive 2 moneys under paragraph “a” in the same manner and, except 3 as provided in paragraph “c” , to the same extent as if they 4 were school districts. The superintendent of each school or 5 institution specified in this paragraph “b” shall certify the 6 basic enrollments of the school or institution administered by 7 the superintendent to the department of education by October 1. 8 c. Notwithstanding paragraph “b” , the amount of moneys 9 allocated to state resource centers and mental health 10 institutes specified in paragraph “b” , shall be a total of 11 not more than forty-five thousand dollars for each fiscal 12 year. The department of education shall distribute the amount 13 allocated proportionately between the four institutions. 14 3. From the moneys appropriated in subsection 1, the sum of 15 four hundred fifty thousand dollars shall be divided among the 16 area education agencies based upon each area education agency's 17 percentage of the total full-time equivalent elementary and 18 secondary teachers employed in the school districts in this 19 state. 20 4. For each year in which an appropriation is made 21 under subsection 1 for purposes of the school improvement 22 technology program, the department of education shall notify 23 the department of revenue and finance of the amount to be paid 24 to each school district, area education agency, and schools and 25 institutions specified in subsection 1, paragraph “b” , based 26 upon the distribution plan set forth for the appropriation made 27 pursuant to this section. The allocation under this section 28 to each school district, area education agency, school, and 29 institution shall be made in one payment on or about October 15 30 of the fiscal year in which the appropriation is made, taking 31 into consideration the relative budget and cash position of the 32 state resources. 33 5. a. Moneys received by a school district or area 34 education agency under this section shall not be commingled 35 -2- LSB 2183HH (5) 85 kh/sc 2/ 7
H.F. 402 with state aid payments made under sections 257.16 and 257.35 1 and shall be accounted for by the local school district or area 2 education agency separately from state aid payments. 3 b. Payments made to school districts and area education 4 agencies under this section are miscellaneous income for 5 purposes of chapter 257 or are considered encumbered. 6 6. The schools and institutions specified in subsection 7 1, paragraph “b” , and each school district and area education 8 agency shall maintain a separate listing within their budgets 9 for payments received and expenditures made pursuant to this 10 section. 11 7. Moneys received under this section shall not be used for 12 payment of any collective bargaining agreement or arbitrator's 13 decision negotiated or awarded under chapter 20. 14 Sec. 3. NEW SECTION . 295.3 School improvement technology 15 planning. 16 1. Prior to receiving funds under this chapter, the board 17 of directors of a school district shall adopt a technology 18 plan that supports school improvement technology efforts 19 and includes an evaluation component. The plan shall be 20 developed by licensed professional staff of the district, 21 including both teachers and administrators. The plan shall, 22 at a minimum, focus on the attainment of student achievement 23 goals, recommended pursuant to section 280.12 and set forth in 24 the school district’s comprehensive school improvement plan 25 submitted to the department of education in compliance with 26 section 256.7, subsection 21, and shall demonstrate how the 27 board will utilize technology to improve student achievement. 28 A district needs to develop only one plan while this chapter 29 is effective. The technology plan shall be kept on file in the 30 district and a copy of the plan, and any subsequent amendments 31 to the plan, shall be sent to the appropriate area education 32 agency. Progress made under the plan shall be included as part 33 of the comprehensive school improvement plan. 34 2. Prior to receiving funds under this chapter, each area 35 -3- LSB 2183HH (5) 85 kh/sc 3/ 7
H.F. 402 education agency shall provide to the department of education 1 adequate assurance that the agency has developed or is 2 developing a plan to assist school districts in the development 3 of a technology planning process to meet the purposes of this 4 chapter. The plan shall describe how the area education 5 agency intends to support school districts with instructional 6 technology staff development and training. An area education 7 agency needs to develop only one plan while this chapter is 8 effective. An annual progress report shall be submitted to the 9 department of education. 10 3. Prior to receiving funds under this chapter, the 11 superintendents of the schools and institutions specified 12 in section 295.2, subsection 2, paragraph “b” , shall each 13 develop a technology plan that supports and improves student 14 achievement, demonstrates how technology will be utilized 15 to improve student achievement, and includes an evaluation 16 component. Each school and institution needs to develop only 17 one plan while this chapter is effective. The plan shall be 18 sent to the state board of regents or the department of human 19 services, as appropriate, and to the department of education. 20 An annual progress report shall be submitted to the state board 21 of regents or the department of human services, as appropriate, 22 and to the department of education. 23 Sec. 4. NEW SECTION . 295.4 School improvement technology 24 expenditures. 25 1. Funds received pursuant to section 295.2 shall be used 26 for the acquisition, lease, lease-purchase, installation, and 27 maintenance of instructional technology equipment, including 28 computers, one-to-one laptop computer programs, long-distance 29 learning, hardware and software, wiring, and materials and 30 supplies related to instructional technology. 31 2. Funds received by an area education agency pursuant 32 to section 295.2 shall be expended for the costs related 33 to supporting school districts, schools, and institutions 34 within the area served with technology planning and equipment, 35 -4- LSB 2183HH (5) 85 kh/sc 4/ 7
H.F. 402 including computers, one-to-one laptop computer programs, 1 long-distance learning, hardware and software, wiring, and 2 materials and supplies related to instructional technology. 3 An area education agency may contract with an appropriate 4 accredited institution of higher education in Iowa to provide 5 staff development and training to implement the purposes of 6 this chapter. 7 3. Funds received pursuant to section 295.2 shall not be 8 expended to add a full-time equivalent position or otherwise 9 increase staffing. 10 Sec. 5. NEW SECTION . 295.5 Future repeal. 11 This chapter is repealed July 1, 2018. 12 EXPLANATION 13 This bill enacts new Code chapter 295, establishing a 14 school improvement technology program, and appropriates $25 15 million from the general fund of the state to the department 16 of education for FY 2013-2014 and FY 2014-2015 for purposes 17 of disbursing funds to public schools, area education 18 agencies (AEAs), and other public educational institutions 19 for the acquisition, lease, lease-purchase, installation, and 20 maintenance of instructional technology equipment, including 21 computers, one-to-one laptop computer programs, long-distance 22 learning, hardware and software, wiring, and materials and 23 supplies related to instructional technology. Funds received 24 shall not be used to increase staffing. 25 The moneys allocated to the AEAs, $450,000, shall be 26 distributed to the AEAs based upon each AEA’s percentage of the 27 total full-time equivalent elementary and secondary teachers 28 employed in the school districts in this state. An AEA may 29 contract with an appropriate accredited institution of higher 30 education in Iowa to provide staff development and training to 31 assist school districts in implementing the Code chapter. 32 Moneys remaining after the disbursement to the AEAs shall 33 be allocated to school districts in the proportion that the 34 basic enrollment of a district bears to the sum of the basic 35 -5- LSB 2183HH (5) 85 kh/sc 5/ 7
H.F. 402 enrollments of all school districts in the state for the budget 1 year. However, a district shall not receive less than $15,000 2 per year. 3 The Iowa braille and sight saving school, the state school 4 for the deaf, the Glenwood state resource center, Woodward 5 state resource center, the mental health institute at Cherokee, 6 the mental health institute at Independence, the state training 7 school, and the Iowa juvenile home shall also receive moneys 8 under the program in the same manner and to the same extent as 9 if they were school districts, except that the Glenwood state 10 resource center, Woodward state resource center, the mental 11 health institute at Cherokee, and the mental health institute 12 at Independence shall divide a total of $45,000 proportionately 13 amongst the four institutions. The superintendents of those 14 schools and institutions must certify the basic enrollments of 15 their institutions to the department of education by October 1. 16 Moneys received under new Code chapter 295 shall not be 17 used for payment of any collective bargaining agreement or 18 arbitrator’s decision negotiated or awarded under Code chapter 19 20. 20 Prior to receiving funds, the board of directors of a school 21 district shall adopt a technology plan. The plan shall be 22 developed by licensed professional staff of the district, 23 including both teachers and administrators. The plan shall, at 24 a minimum, focus on the attainment of student achievement goals 25 and shall demonstrate how the board will utilize technology 26 to improve student achievement. Progress made under the 27 plan shall be included as part of the comprehensive school 28 improvement plan submitted to the department of education 29 annually. 30 Prior to receiving funds under new Code chapter 295, each AEA 31 must provide to the department of education adequate assurance 32 that they have developed or are developing a plan to assist 33 school districts in the development of a technology planning 34 process. An annual progress report shall be 2 submitted to the department. 3 Prior to receiving funds under this Code chapter, the Iowa 4 braille and sight saving school, the state school for the 5 deaf, and the institutions receiving funds that are under the 6 control of the department of human services must also develop 7 and submit to the state board of regents or to the department 8 of human services, as appropriate, and to the department of 9 education, a technology plan that supports and improves student 10 achievement, demonstrates the manner in which technology will 11 be utilized to improve student achievement and includes an 12 evaluation component. Each school and institution must also 13 submit an annual progress report to the state board of regents 14 or the department of human services, as appropriate, and to the 15 department of education. 16 Code chapter 295 is repealed July 1, 2018. 17 -7- LSB 2183HH (5) 85 kh/sc 7/ 7
