Section
1.
Section
70A.1,
Code
2013,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
1A.
Beginning
July
1,
2013,
employees
of
3
the
executive
branch,
judicial
branch,
and
legislative
branch
4
shall
not
receive
bonus
pay
unless
otherwise
authorized
by
5
law,
required
pursuant
to
a
contract
of
employment
entered
6
into
before
July
1,
2013,
or
required
pursuant
to
a
collective
7
bargaining
agreement.
This
subsection
does
not
apply
to
8
employees
of
the
state
board
of
regents
who
receive
bonuses
9
funded
by
moneys
from
sources
other
than
appropriations
by
10
the
general
assembly.
For
purposes
of
this
subsection,
“bonus
11
pay”
means
any
additional
remuneration
provided
an
employee
in
12
the
form
of
a
bonus,
including
but
not
limited
to
a
retention
13
bonus,
recruitment
bonus,
exceptional
job
performance
pay,
14
extraordinary
job
performance
pay,
exceptional
performance
pay,
15
extraordinary
duty
pay,
or
extraordinary
or
special
duty
pay,
16
and
any
extra
benefit
not
otherwise
provided
to
other
similarly
17
situated
employees.

Sec.
2.
BONUS
PAY
REVIEW.

1.
The
director
of
the
department
of
management,
the
state
20
court
administrator,
and
the
director
of
the
legislative
21
services
agency
shall
conduct
a
detailed
review
of
the
bonus
22
pay
provided
to
employees
of
the
executive
branch,
judicial
23
branch,
and
legislative
branch,
as
applicable,
for
the
fiscal
24
years
beginning
July
1,
2011,
and
July
1,
2012,
including
who
25
received,
or
will
receive,
pay
that
exceeded
the
salary
range
26
for
that
position
for
that
particular
fiscal
year.

2.
A
written
detailed
account
of
the
review,
to
include
any
28
recommendations
concerning
modifications
or
adjustments
to
a
29
particular
salary
range
or
placement
that
would
eliminate
the
30
use
of
bonus
pay,
shall
be
provided
to
the
chairs
and
ranking
31
members
of
the
appropriation
committees
of
the
general
assembly
32
by
April
1,
2013.

Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
34
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION
1
This
bill
concerns
the
awarding
of
bonuses
to
state
2
employees.

Code
section
70A.1,
concerning
salaries,
vacations,
and
4
leaves
for
state
employees,
is
amended
to
provide
that,
5
effective
July
1,
2013,
employees
of
the
executive
branch,
6
judicial
branch,
and
legislative
branch
shall
not
receive
7
bonus
pay
unless
otherwise
required
by
law,
prior
employment
8
contract,
or
a
collective
bargaining
agreement.
The
bill’s
9
prohibition
on
bonus
pay
does
not
include
employees
of
the
10
board
of
regents.
11
The
bill
also
directs
the
director
of
the
department
of
12
management,
the
state
court
administrator,
and
the
director
of
13
the
legislative
services
agency
to
conduct
a
detailed
review
14
of
the
bonus
pay
provided
to
employees
of
their
respective
15
branches
and
to
submit
a
report
to
the
chairs
and
ranking
16
members
of
the
appropriation
committees
of
the
general
17
assembly.

This
bill
takes
effect
upon
enactment.
