driver’s
license

nonoperator’s
identification

card
records
that
is
provided
by
the
licensee
or
cardholder
to

the
department
of
transportation
for
use
by
law
enforcement,

first
responders,
emergency
medical
service
providers,
or
other
7
medical
personnel
responding
to
or
assisting
with
an
emergency.

ADMINISTRATIVE
RULES.
The
department
of
transportation
10
shall
adopt
rules
pursuant
to
chapter
17A
to
implement
a
11
process
for
the
input,
maintenance,
and
retrieval
of
emergency
12
contact
and
medical
information
in
a
record
associated
with
a
13
person’s
driver’s
license
or
nonoperator’s
identification
card.
14
The
process
shall
allow
a
person
to
self-manage
information
15
voluntarily
provided
by
the
person
electronically
for
use
in
an
16
emergency,
to
be
maintained
as
an
electronic
record
accessible
17
only
to
law
enforcement
personnel
from
an
interface
on
the
18
person’s
driver’s
license
or
nonoperator’s
identification
card.

The
information
provided
by
a
person
shall
not
appear
on
the
20
face
of
the
driver’s
license
or
nonoperator’s
identification
21
card.
The
rules
shall
specify
the
types
of
information
that
22
may
be
stored
pursuant
to
this
section,
which
may
include
23
emergency
contact
information,
medical
information
of
value
24
to
an
emergency
medical
care
provider,
out-of-hospital
25
do-not-resuscitate
orders
issued
in
accordance
with
chapter
26
144A,
the
existence
of
a
living
will,
and
similar
information
27
that
a
person
intends
to
be
conveyed
to
emergency
responders
28
and
emergency
medical
care
providers
in
an
emergency
situation.

EXPLANATION
30
This
bill
requires
the
department
of
transportation
to
31
adopt
administrative
rules
to
implement
a
process
for
the
32
input,
maintenance,
and
retrieval
of
emergency
contact
and
33
medical
information
in
a
record
associated
with
a
person’s

driver’s
license
or
nonoperator’s
identification
card.

Under
the
process,
a
person
could
voluntarily
provide
and
1
self-manage
information
stored
in
an
electronic
format
which
2
could
be
accessed
by
law
enforcement
and
shared
with
emergency
3
responders
and
emergency
medical
care
providers
in
an
emergency
4
situation.
The
department
is
directed
to
specify
by
rule
5
the
types
of
information
that
might
properly
be
included,
6
such
as
personal
contact
information,
medical
information
of
7
value
to
an
emergency
medical
care
provider,
out-of-hospital
8
do-not-resuscitate
orders,
and
the
existence
of
a
living
will.

The
bill
amends
Code
section
22.7
to
provide
that
personal
10
information
contained
on
electronic
driver’s
license
or
11
nonoperator’s
identification
card
records
that
is
provided
by
12
the
licensee
or
cardholder
for
use
by
certain
law
enforcement
13
and
medical
personnel
responding
to
or
assisting
with
an
14
emergency
constitutes
a
confidential
record.
