H.F. 335 Section 1. Section 35A.11, Code 2013, is amended to read as 1 follows: 2 35A.11 Veterans license fee fund. 3 A veterans license fee fund is created in the state treasury 4 under the control of the commission. Notwithstanding section 5 12C.7 , interest or earnings on moneys in the veterans license 6 fee fund shall be credited to the veterans license fee fund. 7 Moneys in the fund are appropriated to the commission to be 8 used to fulfill the responsibilities of the commission. The 9 fund shall include the fees credited by the treasurer of state 10 pursuant to section 321.145, subsection 2, paragraph “b” , 11 subparagraph (3), Code 2013, from the sale of the following 12 special motor vehicle registration plates : as provided in 13 section 321.34, Code 2013. 14 1. Veteran special plates issued pursuant to section 15 321.34, subsection 13 , paragraph “d” . 16 2. National guard special plates issued pursuant to section 17 321.34, subsection 16 . 18 3. Pearl Harbor special plates issued pursuant to section 19 321.34, subsection 17 . 20 4. Purple heart special plates issued pursuant to section 21 321.34, subsection 18 . 22 5. United States armed forces retired special plates issued 23 pursuant to section 321.34, subsection 19 . 24 6. Silver star and bronze star special plates issued 25 pursuant to section 321.34, subsection 20 . 26 7. Distinguished service cross, navy cross, and air force 27 cross special plates issued pursuant to section 321.34, 28 subsection 20A . 29 8. Soldier’s medal, navy and marine corps medal, and 30 airman’s medal special plates issued pursuant to section 31 321.34, subsection 20B . 32 9. H.F. 335 subsection 20C . 1 10. Gold star special plates issued pursuant to section 2 321.34, subsection 24 . 3 Sec. 2. Section 321.34, subsections 16, 17, 18, 19, 20, 20A, 4 20B, 20C, and 24, Code 2013, are amended to read as follows: 5 16. National guard special plates. 6 a. An owner referred to in subsection 12 who is a member 7 of the national guard, as defined in chapter 29A , may, 8 upon written application to the department, order special 9 registration plates with a national guard processed emblem 10 with the . The emblem shall be designed by the department in 11 cooperation with the adjutant general which emblem signifies 12 and shall signify that the applicant is a member of the 13 national guard. The application shall be approved by the 14 department in consultation with the adjutant general. The 15 special plate fees collected by the director under subsection 16 12 , paragraphs “a” and “c” , from the issuance and annual 17 validation of letter-number designated and personalized 18 national guard plates shall be paid monthly to the treasurer 19 of state and deposited in the road use tax fund. The treasurer 20 of state shall transfer monthly from the statutory allocations 21 fund created under section 321.145, subsection 2 , to the 22 veterans license fee fund created in section 35A.11 the amount 23 of the special fees collected under subsection 12 , paragraph 24 “a” , in the previous month for national guard plates. An 25 applicant shall not be charged a fee in addition to the annual 26 registration fee for issuance of letter-number designated 27 national guard plates. The department shall validate the 28 special plates in the same manner as regular registration 29 plates are validated under this section upon payment of the 30 regular annual registration fee. An applicant may obtain 31 personalized national guard plates upon payment of the 32 additional twenty-five-dollar fee for personalized plates as 33 provided in subsection 5. The annual fee for personalized 34 national guard plates is five dollars in addition to the 35 -2- LSB 1531YH (2) 85 dea/nh 2/ 14

Special registration plates 1 with a national guard processed emblem shall be surrendered, as 2 provided in subsection 12 , in exchange for regular registration 3 plates upon termination of the owner’s membership in the active 4 national guard. 5 b. The surviving spouse of a person who was issued special 6 plates under this subsection may continue to use or apply for 7 and use the special plates subject to registration of the 8 special plates in the surviving spouse’s name and upon payment 9 of the annual five-dollar special plate fee and the regular 10 annual registration fee for the vehicle. If the surviving 11 spouse remarries, the surviving spouse shall return the special 12 plates to the department and the department shall issue regular 13 registration plates to the surviving spouse. 14 17. Pearl Harbor special plates. 15 a. An owner referred to in subsection 12 who was at Pearl 16 Harbor, Hawaii, as a member of the armed services of the United 17 States on December 7, 1941, may, upon written application to 18 the department, order special registration plates with a Pearl 19 Harbor processed emblem. The emblem shall be designed by the 20 department in consultation with service organizations. The 21 application is subject to approval by the department. The 22 special plate fees collected by the director under subsection 23 12 , paragraphs “a” and “c” , from the issuance and annual 24 validation of letter-number designated and personalized Pearl 25 Harbor plates shall be paid monthly to the treasurer of state 26 and deposited in the road use tax fund. The treasurer of state 27 shall transfer monthly from the statutory allocations fund 28 created under section 321.145, subsection 2 , to the veterans 29 license fee fund created in section 35A.11 the amount of the 30 special fees collected under subsection 12 , paragraph “a” , in 31 the previous month for Pearl Harbor plates. An applicant shall 32 not be charged a fee in addition to the annual registration fee 33 for issuance of letter-number designated Pearl Harbor plates. 34 The department shall validate the special plates in the same 35 -3- LSB 1531YH (2) 85 dea/nh 3/ 14

An applicant may obtain personalized Pearl Harbor plates 3 upon payment of the additional twenty-five-dollar fee for 4 personalized plates as provided in subsection 5. The annual 5 fee for personalized Pearl Harbor plates is five dollars in 6 addition to the regular annual registration fee. 7 b. The surviving spouse of a person who was issued special 8 plates under this subsection may continue to use or apply for 9 and use the special plates subject to registration of the 10 special plates in the surviving spouse’s name and upon payment 11 of the annual five-dollar special plate fee and the regular 12 annual registration fee for the vehicle. If the surviving 13 spouse remarries, the surviving spouse shall return the special 14 plates to the department and the department shall issue regular 15 registration plates to the surviving spouse. 16 18. Purple heart special plates. 17 a. An owner referred to in subsection 12 who was awarded 18 a purple heart medal by the United States government for 19 wounds received in military or naval combat against an armed 20 enemy of the United States may, upon written application to 21 the department and presentation of satisfactory proof of the 22 award of the purple heart medal, order special registration 23 plates with a purple heart processed emblem. The design of 24 the emblem shall include a representation of a purple heart 25 medal and ribbon. The application is subject to approval by 26 the department in consultation with the adjutant general. The 27 special plate fees collected by the director under subsection 28 12 , paragraphs “a” and “c” , from the issuance and annual 29 validation of letter-number designated and personalized purple 30 heart plates shall be paid monthly to the treasurer of state 31 and deposited in the road use tax fund. The treasurer of state 32 shall transfer monthly from the statutory allocations fund 33 created under section 321.145, subsection 2 , to the veterans 34 license fee fund created in section 35A.11 the amount of the 35 -4- LSB 1531YH (2) 85 dea/nh 4/ 14
H.F. 335 special fees collected under subsection 12 , paragraph “a” , in 1 the previous month for purple heart plates. An applicant shall 2 not be charged a fee in addition to the annual registration fee 3 for issuance of letter-number designated purple heart plates. 4 The department shall validate the special plates in the same 5 manner as regular registration plates are validated under 6 this section upon payment of the regular annual registration 7 fee. An applicant may obtain personalized purple heart plates 8 upon payment of the additional twenty-five-dollar fee for 9 personalized plates as provided in subsection 5. The annual 10 fee for personalized purple heart plates is five dollars in 11 addition to the regular annual registration fee. 12 b. The surviving spouse of a person who was issued special 13 plates under this subsection may continue to use or apply for 14 and use the special plates subject to registration of the 15 special plates in the surviving spouse’s name and upon payment 16 of the annual five-dollar special plate fee and the regular 17 annual registration fee for the vehicle. If the surviving 18 spouse remarries, the surviving spouse shall return the special 19 plates to the department and the department shall issue regular 20 registration plates to the surviving spouse. 21 19. United States armed forces retired special plates. 22 a. An owner referred to in subsection 12 who is a retired 23 member of the United States armed forces may, upon written 24 application to the department and upon presentation of 25 satisfactory proof of membership, order special registration 26 plates with a United States armed forces retired processed 27 emblem. The emblem shall be designed by the department in 28 consultation with service organizations. The application is 29 subject to approval by the department. For purposes of this 30 subsection , a person is considered to be retired if the person 31 is recognized by the United States armed forces as retired 32 from the United States armed forces. The special plate fees 33 collected by the director under subsection 12 , paragraphs 34 “a” and “c” , from the issuance and annual validation of 35 -5- LSB 1531YH (2) 85 dea/nh 5/ 14
H.F. 335 letter-number designated and personalized armed forces retired 1 plates shall be paid monthly to the treasurer of state and 2 deposited in the road use tax fund. The treasurer of state 3 shall transfer monthly from the statutory allocations fund 4 created under section 321.145, subsection 2 , to the veterans 5 license fee fund created in section 35A.11 the amount of the 6 special fees collected under subsection 12 , paragraph “a” , 7 in the previous month for armed forces retired plates. An 8 applicant shall not be charged a fee in addition to the annual 9 registration fee for issuance of letter-number designated 10 armed forces retired plates. The department shall validate 11 the special plates in the same manner as regular registration 12 plates are validated under this section upon payment of the 13 regular annual registration fee. An applicant may obtain 14 personalized armed forces retired plates upon payment of the 15 additional twenty-five-dollar fee for personalized plates as 16 provided in subsection 5. The annual fee for personalized 17 armed forces retired plates is five dollars in addition to the 18 regular annual registration fee. 19 b. The surviving spouse of a person who was issued special 20 plates under this subsection may continue to use or apply for 21 and use the special plates subject to registration of the 22 special plates in the surviving spouse’s name and upon payment 23 of the annual five-dollar special plate fee and the regular 24 annual registration fee for the vehicle. If the surviving 25 spouse remarries, the surviving spouse shall return the special 26 plates to the department and the department shall issue regular 27 registration plates to the surviving spouse. 28 20. Silver or bronze star plates. 29 a. An owner referred to in subsection 12 who was awarded a 30 silver or a bronze star by the United States government , may, 31 upon written application to the department and presentation 32 of satisfactory proof of the award of the silver or bronze 33 star, order special registration plates with a silver or bronze 34 star processed emblem. The 1 special plate fees collected by the director under subsection 2 12 , paragraphs “a” and “c” , from the issuance and annual 3 validation of letter-number designated and personalized silver 4 star and bronze star plates shall be paid monthly to the 5 treasurer of state and deposited in the road use tax fund. The 6 treasurer of state shall transfer monthly from the statutory 7 allocations fund created under section 321.145, subsection 2 , 8 to the veterans license fee fund created in section 35A.11 9 the amount of the special fees collected under subsection 10 12 , paragraph “a” , in the previous month for silver star and 11 bronze star plates. An applicant shall not be charged a fee 12 in addition to the annual registration fee for issuance of 13 letter-number designated silver star or bronze star plates. 14 The department shall validate the special plates in the same 15 manner as regular registration plates are validated under this 16 section upon payment of the regular annual registration fee. 17 An applicant may obtain personalized silver star or bronze 18 star plates upon payment of the additional twenty-five-dollar 19 fee for personalized plates as provided in subsection 5. The 20 annual fee for personalized silver star or bronze star plates 21 is five dollars in addition to the regular annual registration 22 fee. 23 b. The surviving spouse of a person who was issued special 24 plates under this subsection may continue to use or apply for 25 and use the special plates subject to registration of the 26 special plates in the surviving spouse’s name and upon payment 27 of the annual five-dollar special plate fee and the regular 28 annual registration fee for the vehicle. If the surviving 29 spouse remarries, the surviving spouse shall return the special 30 plates to the department and the department shall issue regular 31 registration plates to the surviving spouse. 32 20A. Distinguished service, navy, or air force cross plates. 33 a. An owner referred to in subsection 12 who was awarded 34 a distinguished service cross, a navy cross, or an air force 35 -7- LSB 1531YH (2) 85 dea/nh 7/ 14
H.F. 335 cross by the United States government may, upon written 1 application to the department and presentation of satisfactory 2 proof of the award, order special registration plates with 3 a distinguished service cross, navy cross, or air force 4 cross processed emblem. The emblem shall be designed by the 5 department in consultation with the adjutant general. The 6 special plate fees collected by the director under subsection 7 12 , paragraphs “a” and “c” , from the issuance and annual 8 validation of letter-number designated and personalized 9 distinguished service cross, navy cross, and air force cross 10 plates shall be paid monthly to the treasurer of state and 11 deposited in the road use tax fund. The treasurer of state 12 shall transfer monthly from the statutory allocations fund 13 created under section 321.145, subsection 2 , to the veterans 14 license fee fund created in section 35A.11 the amount of the 15 special fees collected under subsection 12 , paragraph “a” , 16 in the previous month for distinguished service cross, navy 17 cross, and air force cross plates. An applicant shall not be 18 charged a fee in addition to the annual registration fee for 19 issuance of letter-number designated distinguished service 20 cross, navy cross, or air force cross plates. The department 21 shall validate the special plates in the same manner as regular 22 registration plates are validated under this section upon 23 payment of the regular annual registration fee. An applicant 24 may obtain personalized distinguished service cross, navy 25 cross, or air force cross plates upon payment of the additional 26 twenty-five-dollar fee for personalized plates as provided in 27 subsection 5. The annual fee for personalized distinguished 28 service cross, navy cross, or air force cross plates is five 29 dollars in addition to the regular annual registration fee. 30 b. The surviving spouse of a person who was issued special 31 plates under this subsection may continue to use or apply for 32 and use the special plates subject to registration of the 33 special plates in the surviving spouse’s name and upon payment 34 of the annual five-dollar special plate fee and the regular 35 -8- LSB 1531YH (2) 85 dea/nh 8/ 14

If the surviving 1 spouse remarries, the surviving spouse shall return the special 2 plates to the department and the department shall issue regular 3 registration plates to the surviving spouse. 4 20B. Soldier’s, navy and marine corps, or airman’s medal 5 plates. 6 a. An owner referred to in subsection 12 who was awarded a 7 soldier’s medal, a navy and marine corps medal, or an airman’s 8 medal by the United States government may, upon written 9 application to the department and presentation of satisfactory 10 proof of the award, order special registration plates with 11 a soldier’s medal, navy and marine corps medal, or airman’s 12 medal processed emblem. The emblem shall be designed by the 13 department in consultation with the adjutant general. The 14 special plate fees collected by the director under subsection 15 12 , paragraphs “a” and “c” , from the issuance and annual 16 validation of letter-number designated and personalized 17 soldier’s medal, navy and marine corps medal, and airman’s 18 medal plates shall be paid monthly to the treasurer of state 19 and deposited in the road use tax fund. The treasurer of state 20 shall transfer monthly from the statutory allocations fund 21 created under section 321.145, subsection 2 , to the veterans 22 license fee fund created in section 35A.11 the amount of the 23 special fees collected under subsection 12 , paragraph “a” , in 24 the previous month for soldier’s medal, navy and marine corps 25 medal, and airman’s medal plates. An applicant shall not be 26 charged a fee in addition to the annual registration fee for 27 issuance of letter-number designated soldier’s medal, navy and 28 marine corps medal, or airman’s medal plates. The department 29 shall validate the special plates in the same manner as regular 30 registration plates are validated under this section upon 31 payment of the regular annual registration fee. An applicant 32 may obtain personalized soldier’s medal, navy and marine corps 33 medal, or airman’s medal plates upon payment of the additional 34 twenty-five-dollar fee for personalized plates as provided in 35 -9- LSB 1531YH (2) 85 dea/nh 9/ 14

The annual fee for personalized soldier’s medal, 1 navy and marine corps medal, or airman’s medal plates is five 2 dollars in addition to the regular annual registration fee. 3 b. The surviving spouse of a person who was issued special 4 plates under this subsection may continue to use or apply for 5 and use the special plates subject to registration of the 6 special plates in the surviving spouse’s name and upon payment 7 of the annual five-dollar special plate fee and the regular 8 annual registration fee for the vehicle. If the surviving 9 spouse remarries, the surviving spouse shall return the special 10 plates to the department and the department shall issue regular 11 registration plates to the surviving spouse. 12 20C. Combat infantryman badge, combat action badge, combat 13 action ribbon, air force combat action medal, and combat medical 14 badge plates. 15 a. The department, in consultation with the adjutant 16 general, shall design combat infantryman badge, combat 17 action badge, combat action ribbon, air force combat action 18 medal, and combat medical badge distinguishing processed 19 emblems. Upon receipt of two hundred fifty orders for combat 20 infantryman badge, combat action badge, combat action ribbon, 21 air force combat action medal, or combat medical badge special 22 registration plates, accompanied by a start-up fee of twenty 23 dollars per order, the department shall begin issuing special 24 registration plates with the applicable distinguishing 25 processed emblem as provided in paragraphs “b” and “c” . The 26 minimum order requirement shall apply separately to each of the 27 special registration plates created under this subsection . 28 b. An owner referred to in subsection 12 who was awarded a 29 combat infantryman badge, combat action badge, combat action 30 ribbon, air force combat action medal, or combat medical 31 badge by the United States government may, upon written 32 application to the department and presentation of satisfactory 33 proof of the award, order special registration plates with a 34 combat infantryman badge, combat action badge, combat action 35 -10- LSB 1531YH (2) 85 dea/nh 10/ 14
H.F. 335 ribbon, air force combat action medal, or combat medical badge 1 processed emblem. The special plate fees collected by the 2 director under subsection 12 , paragraphs “a” and “c” , from the 3 issuance and annual validation of letter-number designated and 4 personalized combat infantryman badge, combat action badge, 5 combat action ribbon, air force combat action medal, and combat 6 medical badge plates shall be paid monthly to the treasurer of 7 state and deposited in the road use tax fund. The treasurer 8 of state shall transfer monthly from the statutory allocations 9 fund created under section 321.145, subsection 2 , to the 10 veterans license fee fund created in section 35A.11 the amount 11 of the special fees collected under subsection 12 , paragraph 12 “a” , in the previous month for combat infantryman badge, combat 13 action badge, combat action ribbon, air force combat action 14 medal, and combat medical badge plates. An applicant shall not 15 be charged a fee in addition to the annual registration fee for 16 issuance of letter-number designated combat infantryman badge, 17 combat action badge, combat action ribbon, air force combat 18 action medal, or combat medical badge plates. The department 19 shall validate the special plates in the same manner as regular 20 registration plates are validated under this section upon 21 payment of the regular annual registration fee. An applicant 22 may obtain personalized combat infantryman badge, combat action 23 badge, combat action ribbon, air force combat action medal, 24 or combat medical badge plates upon payment of the additional 25 twenty-five-dollar fee for personalized plates as provided 26 in subsection 5. The annual fee for personalized combat 27 infantryman badge, combat action badge, combat action ribbon, 28 air force combat action medal, or combat medical badge plates 29 is five dollars in addition to the regular annual registration 30 fee. 31 c. b. The surviving spouse of a person who was issued 32 special plates under this subsection may continue to use or 33 apply for and use the special plates subject to registration 34 of the special plates in the surviving spouse’s name and 35 -11- LSB 1531YH (2) 85 dea/nh 11/ 14
H.F. 335 upon payment of the annual five-dollar special plate fee and 1 the regular annual registration fee for the vehicle. If the 2 surviving spouse remarries, the surviving spouse shall return 3 the special plates to the department and the department shall 4 issue regular registration plates to the surviving spouse. 5 24. Gold star plates. An owner referred to in subsection 6 12 who is the surviving spouse, parent, child, or sibling of 7 a deceased member of the United States armed forces who died 8 while serving on active duty during a time of military conflict 9 or who died as a result of such service may order special 10 registration plates bearing a gold star emblem upon written 11 application to the department accompanied by satisfactory 12 supporting documentation as determined by the department. 13 The gold star emblem shall be designed by the department in 14 cooperation with the commission of veterans affairs. The 15 special plate fees collected by the director under subsection 16 12 , paragraphs “a” and “c” , from the issuance and annual 17 validation of letter-number designated and personalized gold 18 star plates shall be paid monthly to the treasurer of state and 19 deposited in the road use tax fund. The treasurer of state 20 shall transfer monthly from the statutory allocations fund 21 created under section 321.145, subsection 2 , to the veterans 22 license fee fund created in section 35A.11 the amount of the 23 special fees collected under subsection 12 , paragraph “a” , in 24 the previous month for gold star plates. An applicant shall 25 not be charged a fee in addition to the annual registration 26 fee for issuance of letter-number designated gold star plates. 27 The department shall validate the special plates in the same 28 manner as regular registration plates are validated under 29 this section upon payment of the regular annual registration 30 fee. An applicant may obtain personalized gold star plates 31 upon payment of the additional twenty-five-dollar fee for 32 personalized plates as provided in subsection 5. H.F. 335 Sec. 3. Section 321.34, Code 2013, is amended by adding the 1 following new subsection: 2 NEW SUBSECTION . 27. United States veteran plates. An 3 owner referred to in subsection 12 who served in the armed 4 forces of the United States and was discharged under honorable 5 conditions may, upon written application to the department and 6 presentation of satisfactory proof of military service and 7 honorable discharge, order special registration plates with a 8 distinguishing processed emblem depicting the word “veteran” 9 below an image of the American flag. An applicant shall 10 not be charged a fee in addition to the annual registration 11 fee for issuance of letter-number designated veteran plates. 12 The department shall validate the special plates in the same 13 manner as regular registration plates are validated under 14 this section upon payment of the regular annual registration 15 fee. An applicant may obtain personalized veteran plates 16 upon payment of the additional twenty-five-dollar fee for 17 personalized plates as provided in subsection 5. The annual 18 fee for personalized veteran plates is five dollars in addition 19 to the regular annual registration fee. 20 Sec. 4. Section 321.145, subsection 2, paragraph b, 21 subparagraph (3), Code 2013, is amended to read as follows: 22 (3) The amounts required to be transferred pursuant to 23 section 321.34 from revenues available under this subsection 24 shall be transferred and credited as provided in section 25 321.34, subsections 7, 10, 10A, 11, 11A, 11B, 13, 16, 17, 26 18, 19, 20, 20A, 20B, 20C, 21, 22, 23, 24, 25, and 26 for the 27 various purposes specified in those subsections. 28 EXPLANATION 29 This bill eliminates the special plate fees charged for 30 special motor vehicle registration plates associated with 31 military service which are established statutorily. The 32 affected plates are national guard plates; Pearl Harbor 33 plates; purple heart plates; United States armed forces retired 34 plates; silver star and bronze star plates; distinguished 35 -13- LSB 1531YH (2) 85 dea/nh 13/ 14
H.F. 335 service cross, navy cross, and air force cross special plates; 1 soldier’s medal, navy and marine corps medal, and airman’s 2 medal special plates; and gold star plates. The bill also 3 eliminates special plate fees for United States veteran plates, 4 which were established by the department of transportation, 5 in cooperation with the commission of veterans affairs, by 6 administrative process. 7 Under current law, the fees for the affected military plates 8 which are established by statute are the standard special plate 9 fees established in Code section 321.34. The fee for issuance 10 of the special plates is $25, and the annual validation fee 11 is $5, both in addition to the regular annual registration 12 fee. The issuance fee for United States veteran plates is $35, 13 and the annual validation fee is $10. The amount of revenue 14 from the special plate issuance fees and the special plate 15 validation fees is credited to the veterans license fee fund 16 administered by the commission of veterans affairs. The bill 17 eliminates the special plate fees that accrue to the veterans 18 license fee fund from the special military plates. The bill 19 adds the United States armed forces veteran plate, which is 20 currently established administratively, to the list of special 21 motor vehicle registration plates established in Code section 22 321.34. 23 Personalized plate fees and annual registration fees for 24 special military plates are credited to the road use tax fund 25 and are not affected under the bill. 26 The bill amends Code section 35A.11 to reflect that new 27 moneys will not be credited to the veterans license fee fund 28 upon the elimination of special plate fees for motor vehicle 29 registration plates associated with military service. 30 -14- LSB 1531YH (2) 85 dea/nh 14/ 14
