H.F. 332 Section 1. Section 99D.7, subsection 23, Code 2013, is 1 amended to read as follows: 2 23. To require licensees to establish a process to allow 3 a person to be voluntarily excluded for life from a racetrack 4 enclosure and all other licensed facilities under this chapter 5 and chapter 99F as provided in this subsection. The process 6 shall provide that an initial request by a person to be 7 voluntarily excluded shall be for a period of five years or 8 life and a subsequent request following the five-year period 9 shall be for a period of five years or life. A request by 10 a person to be voluntarily excluded following the second 11 five-year period shall be for life . The process established 12 shall also require that a licensee disseminate information 13 regarding persons voluntarily excluded to all licensees under 14 this chapter and chapter 99F . The state and any licensee under 15 this chapter or chapter 99F shall not be liable to any person 16 for any claim which may arise from this process. In addition 17 to any other penalty provided by law, any money or thing of 18 value that has been obtained by, or is owed to, a voluntarily 19 excluded person by a licensee as a result of wagers made by the 20 person after the person has been voluntarily excluded shall not 21 be paid to the person but shall be credited to the general fund 22 of the state. 23 Sec. 2. Section 99F.4, subsection 22, Code 2013, is amended 24 to read as follows: 25 22. To require licensees to establish a process to allow a 26 person to be voluntarily excluded for life from an excursion 27 gambling boat and all other licensed facilities under this 28 chapter and chapter 99D as provided in this subsection. The 29 process shall provide that an initial request by a person to 30 be voluntarily excluded shall be for a period of five years 31 or life and a subsequent request following the five-year 32 period shall be for a period of five years or life. GAMBLING SELF-EXCLUSION —— REAPPLICATION. 12 1. A person who has been voluntarily excluded for life 13 from a racetrack enclosure, an excursion gambling boat, and 14 all other licensed facilities under Code chapters 99D and 99F 15 pursuant to the process established in Code sections 99D.7 and 16 99F.4 prior to the effective date of this Act may reapply to 17 the licensed facilities to revoke the exclusion, pursuant to a 18 process established by the licensed facilities in accordance 19 with the requirements of the racing and gaming commission. A 20 person may reapply to revoke the voluntary exclusion only if 21 the person has been voluntarily excluded for a period of at 22 least five years. 23 2. Following a revocation of a voluntary exclusion 24 as provided by this section, a subsequent request to be 25 voluntarily excluded shall be as provided for a subsequent 26 request pursuant to the process described in Code sections 27 99D.7 and 99F.4, as amended by this Act. 28 EXPLANATION 29 This bill concerns the process by which a person can be 30 voluntarily excluded from a racetrack enclosure under Code 31 chapter 99D and from an excursion gambling boat and all other 32 licensed facilities under Code chapter 99F. 33 The bill provides that an initial request to be voluntarily 34 excluded shall be for a period of five years or for life and a 35 -2- LSB 1127YH (1) 85 ec/nh 2/ 3

H.F. 332 subsequent request by that person after the five-year period 1 shall be for five years or life. The bill further provides 2 that a request following the second five-year exclusion 3 period shall be for life. Under current law, a request to be 4 voluntarily excluded is for life. 5 The bill also provides that for a person who has been 6 voluntarily excluded for life from a gambling facility prior to 7 the effective date of the bill, the person may reapply to have 8 the exclusion revoked if the person has been excluded for at 9 least five years. The bill provides that if a person revokes 10 their exclusion, a subsequent request for exclusion shall be as 11 otherwise provided in the bill. 12 -3- LSB 1127YH (1) 85 ec/nh 3/ 3
