H.F. 2412 Section 1. NEW SECTION . 256.25 School radon testing and 1 mitigation grant program. 2 1. A school radon testing and mitigation grant program 3 is established in the department to award grants to school 4 districts for purposes of radon testing and mitigation 5 at attendance centers. The department of education shall 6 administer the program in collaboration with the department of 7 public health. 8 2. A school district awarded a grant in accordance with this 9 section for purposes of radon testing shall retain a person 10 certified pursuant to section 136B.1 to conduct the testing. 11 A school district awarded a grant in accordance with this 12 section for purposes of radon mitigation shall retain a person 13 credentialed to perform radon abatement measures pursuant to 14 section 136B.1 to conduct the mitigation. Radon testing and 15 radon mitigation funded by a grant from the program shall be 16 conducted as prescribed by the department of public health. 17 3. The department of education shall develop grant 18 application, selection, and evaluation criteria. Such criteria 19 shall include but are not limited to the results of any 20 previous radon testing and mitigation conducted at attendance 21 centers in the school district; the financial need of the 22 school district as determined by criteria including but not 23 limited to the budget enrollment of a school district and 24 the extent to which a school district’s adjusted additional 25 property tax levy rate exceeds the statewide maximum adjusted 26 additional property tax levy rate, as calculated under section 27 257.15, subsection 4; and the amount of any commitment of 28 matching funds by the school district. A school district 29 shall not be eligible for a grant for the purpose of radon 30 mitigation at an attendance center unless the results of a 31 radon test conducted at the attendance center were at or above 32 four picocuries per liter. 33 4. The amount of a grant awarded in accordance with this 34 section shall not exceed fifty thousand dollars per school 35 -1- LSB 5970YH (2) 85 je/rj 1/ 3

H.F. 2412 district. 1 5. The department of education and the department of public 2 health shall each adopt rules to administer this section. 3 Sec. 2. APPROPRIATION. There is appropriated from the 4 general fund of the state to the department of education 5 for the fiscal year beginning July 1, 2014, and ending June 6 30, 2015, the following amount, to be used for the purposes 7 designated: 8 For the awarding of grants from the school radon testing and 9 mitigation grant program established in section 256.25: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,000,000 11 Notwithstanding section 8.33, moneys appropriated in this 12 section that remain unencumbered or unobligated at the close of 13 the fiscal year shall not revert but shall remain available for 14 expenditure for the purposes designated until the close of the 15 succeeding fiscal year. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill establishes a school radon testing and mitigation 20 grant program in the department of education for purposes 21 of radon testing and mitigation at attendance centers. The 22 program will be administered by the department of education in 23 collaboration with the department of public health. 24 A school district that receives a grant for radon testing 25 must retain a person certified by the department of public 26 health to conduct the testing. A school district that receives 27 a grant for radon mitigation must retain a person credentialed 28 to perform radon abatement measures by the department of public 29 health to conduct the mitigation. Radon testing and radon 30 mitigation funded by a grant from the program must be conducted 31 as prescribed by the department of public health. 32 The department of education must develop grant application, 33 selection, and evaluation criteria. H.F. 2412 testing and mitigation conducted at attendance centers in the 1 school district; the financial need of the school district 2 as determined by certain criteria; and the amount of any 3 commitment of matching funds by the school district. A school 4 district can only be eligible for a grant for the purpose of 5 radon mitigation at an attendance center if results of a radon 6 test conducted at the attendance center were at or above four 7 picocuries per liter. 8 The amount of a grant cannot exceed $50,000 per school 9 district. 10 The bill appropriates $1 million to the department of 11 education for fiscal year 2014-2015 to be used for school radon 12 testing and mitigation grants. 13 -3- LSB 5970YH (2) 85 je/rj 3/ 3
