1.
As
used
in
this
section,
unless
the
context
otherwise
3
requires:
4
a.
“Abandoned
building”
means
a
building
that
is
owned
by
an
5
eligible
community
that
has
been
abandoned
for
three
or
more
6
years.
7
b.
“Eligible
community”
means
a
city
with
a
population
of
8
five
thousand
or
fewer.

2.
The
department
shall
establish
and
administer
a
derelict
10
building
grant
program
to
provide
financial
assistance
11
to
eligible
communities
to
address
abandoned
buildings
by
12
promoting
waste
abatement,
diversion,
selective
dismantlement
13
of
building
components,
and
recycling.
The
program
shall
be
14
administered
in
accordance
with
rules
adopted
by
the
commission
15
pursuant
to
chapter
17A.

3.
Financial
assistance
under
the
program
shall
consist
17
of
grants
in
an
amount
not
to
exceed
five
hundred
thousand
18
dollars.
A
grant
shall
not
exceed
seventy-five
percent
of
the
19
total
costs
of
promoting
waste
abatement,
diversion,
selective
20
dismantlement,
and
recycling
of
a
single
abandoned
building.

Eligible
costs
for
financial
assistance
under
the
22
program
include
but
are
not
limited
to
asbestos
and
other
23
hazardous
material
abatement
and
removal,
the
recovery
and
24
processing
of
recyclable
or
reusable
material
through
selective
25
dismantlement,
and
reimbursement
for
purchased
recycled
content
26
materials
used
in
the
renovation
of
buildings.

5.
a.
A
derelict
building
grant
fund
is
created
in
the
28
state
treasury
under
the
control
of
the
department.
The
fund
29
shall
include
moneys
appropriated
by
the
general
assembly
and
30
any
other
moneys
available
to
and
obtained
or
accepted
by
the
31
department,
including
moneys
from
public
or
private
sources.
32
Moneys
in
the
fund
are
appropriated
to
the
department
and
shall
33
be
used
exclusively
to
carry
out
the
provisions
of
this
section
34
as
determined
by
the
department,
and
shall
not
require
further

special
authorization
by
the
general
assembly.

b.
Notwithstanding
section
8.33,
moneys
appropriated
in
this
2
section
that
remain
unencumbered
or
unobligated
at
the
close
of
3
the
fiscal
year
shall
not
revert
but
shall
remain
available
for
4
expenditure
for
the
purposes
designated
until
the
close
of
the
5
fiscal
year
that
ends
five
years
after
the
end
of
the
fiscal
6
year
for
which
the
appropriation
was
made.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
natural
resources
to
11
create
a
derelict
building
grant
program
to
provide
financial
12
assistance
to
eligible
communities
to
address
abandoned
13
buildings
by
promoting
waste
abatement,
diversion,
selective
14
dismantlement
of
building
components,
and
recycling.
Under
15
the
program,
an
eligible
community
is
a
city
with
a
population
16
of
5,000
or
fewer.
Financial
assistance
under
the
program
17
shall
consist
of
grants
in
an
amount
not
to
exceed
$500,000
18
and
a
grant
shall
not
exceed
75
percent
of
the
total
costs
of
19
promoting
waste
abatement,
diversion,
selective
dismantlement,
20
and
recycling
of
a
single
abandoned
building.
Eligible
21
costs
for
financial
assistance
include
but
are
not
limited
to
22
asbestos
and
other
hazardous
material
abatement
and
removal,
23
the
recovery
and
processing
of
recyclable
or
reusable
material
24
through
selective
dismantlement,
and
reimbursement
for
25
purchased
recycled
content
materials
used
in
the
renovation
of
26
buildings.

The
bill
creates
a
derelict
building
grant
fund
in
the
state

treasury
under
the
control
of
the
department.
