H.F. 2351 Section 1. Section 35A.11, Code 2014, is amended to read as 1 follows: 2 35A.11 Veterans license fee fund. 3 1. A veterans license fee fund is created in the state 4 treasury under the control of the commission. Notwithstanding 5 section 12C.7 , interest or earnings on moneys in the veterans 6 license fee fund shall be credited to the veterans license fee 7 fund. Moneys in the fund are appropriated to the commission to 8 be used to fulfill the responsibilities of the commission. 9 2. The fund created in this section shall include the 10 fees credited by the treasurer of state from the sale annual 11 validation of the following special motor vehicle registration 12 plates: 13 1. Veteran special plates issued pursuant to section 14 321.34, subsection 13 , paragraph “d” . 15 2. a. National guard special plates issued pursuant to 16 section 321.34, subsection 16 . 17 3. b. Pearl Harbor special plates issued pursuant to 18 section 321.34, subsection 17 . 19 4. c. Purple heart special plates issued pursuant to 20 section 321.34, subsection 18 . 21 5. d. United States armed forces retired special plates 22 issued pursuant to section 321.34, subsection 19 . 23 6. e. Silver star and bronze star special plates issued 24 pursuant to section 321.34, subsection 20 . 25 7. f. Distinguished service cross, navy cross, and air 26 force cross special plates issued pursuant to section 321.34, 27 subsection 20A . 28 8. g. Soldier’s medal, navy and marine corps medal, and 29 airman’s medal special plates issued pursuant to section 30 321.34, subsection 20B . 31 9. h. H.F. 2351 10. i. Gold star special plates issued pursuant to section 1 321.34, subsection 24 . 2 j. United States veteran special plates issued pursuant to 3 section 321.34, subsection 27. 4 Sec. 2. Section 321.34, subsection 16, paragraph a, Code 5 2014, is amended to read as follows: 6 a. An owner referred to in subsection 12 who is a member 7 of the national guard, as defined in chapter 29A , may, 8 upon written application to the department, order special 9 registration plates with a national guard processed emblem 10 with the emblem designed by the department in cooperation with 11 the adjutant general which emblem signifies that the applicant 12 is a member of the national guard. The application shall be 13 approved by the department in consultation with the adjutant 14 general. The special plate fees collected by the director 15 under subsection 12 , paragraphs paragraph “a” and “c” , from 16 the issuance and annual validation of letter-number designated 17 national guard plates, and subsection 12, paragraph “c” , from 18 the issuance and annual validation of personalized national 19 guard plates shall be paid monthly to the treasurer of state 20 and deposited in the road use tax fund. The treasurer of state 21 shall transfer monthly from the statutory allocations fund 22 created under section 321.145, subsection 2 , to the veterans 23 license fee fund created in section 35A.11 the amount of the 24 special fees collected under subsection 12 , paragraph “a” , 25 in the previous month for national guard plates. Special 26 registration plates with a national guard processed emblem 27 shall be surrendered, as provided in subsection 12 , in exchange 28 for regular registration plates upon termination of the owner’s 29 membership in the active national guard. 30 Sec. 3. Section 321.34, subsection 16, Code 2014, is amended 31 by adding the following new paragraph: 32 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 33 “a” , an owner who is approved for special registration plates 34 under this subsection shall be issued one set of special 35 -2- LSB 6118HV (1) 85 aw/sc 2/ 11
H.F. 2351 registration plates with a national guard processed emblem at 1 no charge. 2 Sec. 4. Section 321.34, subsection 17, paragraph a, Code 3 2014, is amended to read as follows: 4 a. An owner referred to in subsection 12 who was at Pearl 5 Harbor, Hawaii, as a member of the armed services of the United 6 States on December 7, 1941, may, upon written application to 7 the department, order special registration plates with a Pearl 8 Harbor processed emblem. The emblem shall be designed by the 9 department in consultation with service organizations. The 10 application is subject to approval by the department. The 11 special plate fees collected by the director under subsection 12 12 , paragraphs paragraph “a” and “c” , from the issuance and 13 annual validation of letter-number designated Pearl Harbor 14 plates, and subsection 12, paragraph “c” , from the issuance and 15 annual validation of personalized Pearl Harbor plates shall 16 be paid monthly to the treasurer of state and deposited in 17 the road use tax fund. The treasurer of state shall transfer 18 monthly from the statutory allocations fund created under 19 section 321.145, subsection 2 , to the veterans license fee 20 fund created in section 35A.11 the amount of the special fees 21 collected under subsection 12 , paragraph “a” , in the previous 22 month for Pearl Harbor plates. 23 Sec. 5. Section 321.34, subsection 17, Code 2014, is amended 24 by adding the following new paragraph: 25 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 26 “a” , an owner who is approved for special registration plates 27 under this subsection shall be issued one set of special 28 registration plates with a Pearl Harbor processed emblem at no 29 charge. 30 Sec. 6. Section 321.34, subsection 18, paragraph a, Code 31 2014, is amended to read as follows: 32 a. An owner referred to in subsection 12 who was awarded 33 a purple heart medal by the United States government for 34 wounds received in military or naval combat against an armed 35 -3- LSB 6118HV (1) 85 aw/sc 3/ 11
H.F. 2351 enemy of the United States may, upon written application to 1 the department and presentation of satisfactory proof of the 2 award of the purple heart medal, order special registration 3 plates with a purple heart processed emblem. The design of 4 the emblem shall include a representation of a purple heart 5 medal and ribbon. The application is subject to approval by 6 the department in consultation with the adjutant general. The 7 special plate fees collected by the director under subsection 8 12 , paragraphs paragraph “a” and “c” , from the issuance and 9 annual validation of letter-number designated purple heart 10 plates, and subsection 12, paragraph “c” , from the issuance and 11 annual validation of personalized purple heart plates shall 12 be paid monthly to the treasurer of state and deposited in 13 the road use tax fund. The treasurer of state shall transfer 14 monthly from the statutory allocations fund created under 15 section 321.145, subsection 2 , to the veterans license fee 16 fund created in section 35A.11 the amount of the special fees 17 collected under subsection 12 , paragraph “a” , in the previous 18 month for purple heart plates. 19 Sec. 7. Section 321.34, subsection 18, Code 2014, is amended 20 by adding the following new paragraph: 21 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 22 “a” , an owner who is approved for special registration plates 23 under this subsection shall be issued one set of special 24 registration plates with a purple heart processed emblem at no 25 charge. 26 Sec. 8. Section 321.34, subsection 19, paragraph a, Code 27 2014, is amended to read as follows: 28 a. An owner referred to in subsection 12 who is a retired 29 member of the United States armed forces may, upon written 30 application to the department and upon presentation of 31 satisfactory proof of membership, order special registration 32 plates with a United States armed forces retired processed 33 emblem. The emblem shall be designed by the department in 34 consultation with service organizations. The application is 35 -4- LSB 6118HV (1) 85 aw/sc 4/ 11

For purposes of this 1 subsection , a person is considered to be retired if the person 2 is recognized by the United States armed forces as retired 3 from the United States armed forces. The special plate fees 4 collected by the director under subsection 12 , paragraphs 5 paragraph “a” and “c” , from the issuance and annual validation 6 of letter-number designated armed forces retired plates, and 7 subsection 12, paragraph “c” , from the issuance and annual 8 validation of personalized armed forces retired plates shall 9 be paid monthly to the treasurer of state and deposited in 10 the road use tax fund. The treasurer of state shall transfer 11 monthly from the statutory allocations fund created under 12 section 321.145, subsection 2 , to the veterans license fee 13 fund created in section 35A.11 the amount of the special fees 14 collected under subsection 12 , paragraph “a” , in the previous 15 month for armed forces retired plates. 16 Sec. 9. Section 321.34, subsection 19, Code 2014, is amended 17 by adding the following new paragraph: 18 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 19 “a” , an owner who is approved for special registration plates 20 under this subsection shall be issued one set of special 21 registration plates with an armed forces retired processed 22 emblem at no charge. 23 Sec. 10. Section 321.34, subsection 20, paragraph a, Code 24 2014, is amended to read as follows: 25 a. An owner referred to in subsection 12 who was awarded a 26 silver or a bronze star by the United States government, may, 27 upon written application to the department and presentation 28 of satisfactory proof of the award of the silver or bronze 29 star, order special registration plates with a silver or bronze 30 star processed emblem. The emblem shall be designed by the 31 department in consultation with the adjutant general. The 32 special plate fees collected by the director under subsection 33 12 , paragraphs paragraph “a” and “c” , from the issuance and 34 annual validation of letter-number designated silver star and 35 -5- LSB 6118HV (1) 85 aw/sc 5/ 11
H.F. 2351 bronze star plates, and subsection 12, paragraph “c” , from the 1 issuance and annual validation of personalized silver star and 2 bronze star plates shall be paid monthly to the treasurer of 3 state and deposited in the road use tax fund. The treasurer 4 of state shall transfer monthly from the statutory allocations 5 fund created under section 321.145, subsection 2 , to the 6 veterans license fee fund created in section 35A.11 the amount 7 of the special fees collected under subsection 12 , paragraph 8 “a” , in the previous month for silver star and bronze star 9 plates. 10 Sec. 11. Section 321.34, subsection 20, Code 2014, is 11 amended by adding the following new paragraph: 12 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 13 “a” , an owner who is approved for special registration plates 14 under this subsection shall be issued one set of special 15 registration plates with a silver star or bronze star processed 16 emblem at no charge. 17 Sec. 12. Section 321.34, subsection 20A, paragraph a, Code 18 2014, is amended to read as follows: 19 a. An owner referred to in subsection 12 who was awarded 20 a distinguished service cross, a navy cross, or an air force 21 cross by the United States government may, upon written 22 application to the department and presentation of satisfactory 23 proof of the award, order special registration plates with 24 a distinguished service cross, navy cross, or air force 25 cross processed emblem. The emblem shall be designed by the 26 department in consultation with the adjutant general. The 27 special plate fees collected by the director under subsection 28 12 , paragraphs paragraph “a” and “c” , from the issuance and 29 annual validation of letter-number designated distinguished 30 service cross, navy cross, and air force cross plates, and 31 subsection 12, paragraph “c” , from the issuance and annual 32 validation of personalized distinguished service cross, navy 33 cross, and air force cross plates shall be paid monthly to the 34 treasurer of state and deposited in the road use tax fund. H.F. 2351 treasurer of state shall transfer monthly from the statutory 1 allocations fund created under section 321.145, subsection 2 , 2 to the veterans license fee fund created in section 35A.11 3 the amount of the special fees collected under subsection 12 , 4 paragraph “a” , in the previous month for distinguished service 5 cross, navy cross, and air force cross plates. 6 Sec. 13. Section 321.34, subsection 20A, Code 2014, is 7 amended by adding the following new paragraph: 8 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 9 “a” , an owner who is approved for special registration plates 10 under this subsection shall be issued one set of special 11 registration plates with a distinguished service cross, navy 12 cross, or air force cross processed emblem at no charge. 13 Sec. 14. Section 321.34, subsection 20B, paragraph a, Code 14 2014, is amended to read as follows: 15 a. An owner referred to in subsection 12 who was awarded a 16 soldier’s medal, a navy and marine corps medal, or an airman’s 17 medal by the United States government may, upon written 18 application to the department and presentation of satisfactory 19 proof of the award, order special registration plates with 20 a soldier’s medal, navy and marine corps medal, or airman’s 21 medal processed emblem. The emblem shall be designed by the 22 department in consultation with the adjutant general. The 23 special plate fees collected by the director under subsection 24 12 , paragraphs paragraph “a” and “c” , from the issuance and 25 annual validation of letter-number designated soldier’s medal, 26 navy and marine corps medal, and airman’s medal plates, and 27 subsection 12, paragraph “c” , from the issuance and annual 28 validation of personalized soldier’s medal, navy and marine 29 corps medal, and airman’s medal plates shall be paid monthly 30 to the treasurer of state and deposited in the road use tax 31 fund. The treasurer of state shall transfer monthly from the 32 statutory allocations fund created under section 321.145, 33 subsection 2 , to the veterans license fee fund created in 34 section 35A.11 the amount of the special fees collected 35 -7- LSB 6118HV (1) 85 aw/sc 7/ 11
H.F. 2351 under subsection 12 , paragraph “a” , in the previous month for 1 soldier’s medal, navy and marine corps medal, and airman’s 2 medal plates. 3 Sec. 15. Section 321.34, subsection 20B, Code 2014, is 4 amended by adding the following new paragraph: 5 NEW PARAGRAPH . 0b. Notwithstanding subsection 12, paragraph 6 “a” , an owner who is approved for special registration plates 7 under this subsection shall be issued one set of special 8 registration plates with a soldier’s medal, navy and marine 9 corps medal, or airman’s medal processed emblem at no charge. 10 Sec. 16. Section 321.34, subsection 20C, paragraph b, Code 11 2014, is amended to read as follows: 12 b. An owner referred to in subsection 12 who was awarded a 13 combat infantryman badge, combat action badge, combat action 14 ribbon, air force combat action medal, or combat medical 15 badge by the United States government may, upon written 16 application to the department and presentation of satisfactory 17 proof of the award, order special registration plates with a 18 combat infantryman badge, combat action badge, combat action 19 ribbon, air force combat action medal, or combat medical badge 20 processed emblem. The special plate fees collected by the 21 director under subsection 12 , paragraphs paragraph “a” and 22 “c” , from the issuance and annual validation of letter-number 23 designated combat infantryman badge, combat action badge, 24 combat action ribbon, air force combat action medal, and 25 combat medical badge plates, and subsection 12, paragraph 26 “c” , from the issuance and annual validation of personalized 27 combat infantryman badge, combat action badge, combat action 28 ribbon, air force combat action medal, and combat medical badge 29 plates shall be paid monthly to the treasurer of state and 30 deposited in the road use tax fund. The treasurer of state 31 shall transfer monthly from the statutory allocations fund 32 created under section 321.145, subsection 2 , to the veterans 33 license fee fund created in section 35A.11 the amount of the 34 special fees collected under subsection 12 , paragraph “a” , in 35 -8- LSB 6118HV (1) 85 aw/sc 8/ 11
H.F. 2351 the previous month for combat infantryman badge, combat action 1 badge, combat action ribbon, air force combat action medal, and 2 combat medical badge plates. 3 Sec. 17. Section 321.34, subsection 20C, Code 2014, is 4 amended by adding the following new paragraph: 5 NEW PARAGRAPH . 0c. Notwithstanding subsection 12, paragraph 6 “a” , an owner who is approved for special registration plates 7 under this subsection shall be issued one set of special 8 registration plates with a combat infantryman badge, combat 9 action badge, combat action ribbon, air force combat action 10 medal, and combat medical badge distinguishing processed emblem 11 at no charge. 12 Sec. 18. Section 321.34, subsection 24, Code 2014, is 13 amended to read as follows: 14 24. Gold star plates. 15 a. An owner referred to in subsection 12 who is the 16 surviving spouse, parent, child, or sibling of a deceased 17 member of the United States armed forces who died while serving 18 on active duty during a time of military conflict or who died 19 as a result of such service may order special registration 20 plates bearing a gold star emblem upon written application 21 to the department accompanied by satisfactory supporting 22 documentation as determined by the department. The gold star 23 emblem shall be designed by the department in cooperation with 24 the commission of veterans affairs. The special plate fees 25 collected by the director under subsection 12 , paragraphs 26 paragraph “a” and “c” , from the issuance and annual validation 27 of letter-number designated gold star plates, and subsection 28 12, paragraph “c” , from the issuance and annual validation of 29 personalized gold star plates shall be paid monthly to the 30 treasurer of state and deposited in the road use tax fund. The 31 treasurer of state shall transfer monthly from the statutory 32 allocations fund created under section 321.145, subsection 2 , 33 to the veterans license fee fund created in section 35A.11 34 the amount of the special fees collected under subsection 12 , 35 -9- LSB 6118HV (1) 85 aw/sc 9/ 11
H.F. 2351 paragraph “a” , in the previous month for gold star plates. 1 b. Notwithstanding subsection 12, paragraph “a” , an owner 2 who is approved for special registration plates under this 3 subsection shall be issued one set of special registration 4 plates bearing a gold star emblem at no charge. 5 Sec. 19. Section 321.34, Code 2014, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 27. United States veteran plates. 8 a. An owner referred to in subsection 12 who served in the 9 armed forces of the United States and was discharged under 10 honorable conditions may, upon written application to the 11 department and upon presentation of satisfactory proof of 12 military service and discharge under honorable conditions, 13 order special registration plates bearing a distinguishing 14 processed emblem depicting the word “veteran” below an image 15 of the American flag. The application is subject to approval 16 by the department. The special plate fees collected by the 17 director under subsection 12, paragraph “a” , from the annual 18 validation of letter-number designated United States veteran 19 plates, and subsection 12, paragraph “c” , from the issuance 20 and annual validation of personalized United States veteran 21 plates, shall be paid monthly to the treasurer of state and 22 deposited in the road use tax fund. The treasurer of state 23 shall transfer monthly from the statutory allocations fund 24 created under section 321.145, subsection 2, to the veterans 25 license fee fund created in section 35A.11 the amount of the 26 special fees collected under subsection 12, paragraph “a” , in 27 the previous month for United States veteran plates. 28 b. Notwithstanding subsection 12, paragraph “a” , an owner 29 who is approved for a special registration plate under this 30 subsection shall be issued one set of special registration 31 plates bearing a distinguishing processed emblem depicting 32 the word “veteran” below an image of the American flag at no 33 charge. 34 EXPLANATION 35 -10- LSB 6118HV (1) 85 aw/sc 10/ 11
H.F. 2351 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill relates to fees charged for special registration 3 plates associated with military service. 4 The bill eliminates the special plate issuance fees charged 5 for issuance of certain special motor vehicle registration 6 plates associated with military service which are established 7 statutorily. The affected plates are national guard plates; 8 Pearl Harbor plates; purple heart plates; United States armed 9 forces retired plates; silver star and bronze star plates; 10 distinguished service cross, navy cross, and air force cross 11 special plates; soldier’s medal, navy and marine corps medal, 12 and airman’s medal special plates; and gold star plates. The 13 bill also eliminates special plate issuance fees for United 14 States veteran plates which were established by the department 15 of transportation, in cooperation with the commission of 16 veterans affairs, by administrative process. Under current 17 law, the fee for issuance of the special plates named in Code 18 is $25. The issuance fee for United States veteran plates is 19 $35. The bill adds the United States armed forces veteran 20 plate, which is currently established administratively, to the 21 list of special motor vehicle registration plates established 22 in Code section 321.34. The bill maintains transfers to the 23 veterans license fee fund from the annual validation fees for 24 special plates related to military service.
