H.F. 2350 Section 1. PUBLIC CAFETERIAS —— PURCHASING PREFERENCES AND 1 DIETARY GUIDELINES. 2 1. The department of administrative services, in 3 collaboration with the department of public health and the 4 department of agriculture and land stewardship, shall convene a 5 task force to propose a procurement policy and implementation 6 timeline for the policy requiring all cafeterias at the capitol 7 complex and at all state agency buildings in this state to 8 conform to the United States department of health and human 9 services’ health and sustainability guidelines for federal 10 concessions and vending operations, and to establish purchasing 11 preferences for local producers of food and local beverage 12 providers. 13 2. The state board of regents and the department of 14 education, in collaboration with the department of agriculture 15 and land stewardship, shall also convene a task force to 16 propose a procurement policy and implementation timeline for 17 the policy requiring public collegiate campus cafeterias to 18 conform to the United States department of health and human 19 services’ health and sustainability guidelines for federal 20 concessions and vending operations, and to establish purchasing 21 preferences for local producers of food and local beverage 22 providers. Campus cafeterias addressed in the policy shall 23 include cafeterias located at the university of northern 24 Iowa, Iowa state university, the university of Iowa, and all 25 community colleges. 26 3. The task forces shall submit their procurement policies 27 and implementation timelines to the general assembly by January 28 2, 2015. 29 Sec. 2. NEW SECTION . 8A.319 Purchasing preferences and 30 dietary guidelines for state cafeterias. 31 1. The department of administrative services, along with 32 the state board of regents and the department of education, 33 shall adopt a procurement policy requiring the affected 34 cafeterias to conform to the United States department of health 35 -1- LSB 5527YH (5) 85 jb/rj 1/ 3
H.F. 2350 and human services’ health and sustainability guidelines for 1 federal concessions and vending operations by January 1, 2016. 2 2. The department of administrative services, in 3 collaboration with the department of public health, shall 4 review and update relevant nutrition standards every five 5 years, starting in 2019, to reflect advancements in nutrition 6 science, dietary data, and food product availability. 7 3. Any affected cafeteria’s new or renewal food service 8 contract entered into during calendar year 2015 shall also 9 conform to the appropriate procurement policy adopted pursuant 10 to subsection 1. 11 Sec. 3. Section 135.11, Code 2014, is amended by adding the 12 following new subsection: 13 NEW SUBSECTION . 32. Review and update relevant nutrition 14 standards for affected cafeterias, pursuant to section 8A.319, 15 subsection 2. 16 Sec. 4. Section 256.9, Code 2014, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 65. Adopt and implement a food procurement 19 policy for affected cafeterias, pursuant to section 8A.319. 20 Sec. 5. Section 262.9, Code 2014, is amended by adding the 21 following new subsection: 22 NEW SUBSECTION . 38. Adopt and implement a food procurement 23 policy for affected cafeterias, pursuant to section 8A.319. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to the adoption of dietary guidelines. 28 The United States department of health and human services’ 29 health and sustainability guidelines for federal concessions 30 and vending operations are adopted for public cafeterias at the 31 capitol complex, at all state agency buildings, and at public 32 collegiate institutions in this state. H.F. 2350 to establish purchasing preferences for local producers of food 1 and local beverage providers. 2 The bill requires the department of administrative services, 3 in collaboration with the department of public health and the 4 department of agriculture and land stewardship, to convene 5 a task force that will propose a procurement policy and 6 implementation timeline requiring the specified cafeterias 7 controlled by the department of administrative services to 8 conform to the specified dietary guidelines, and to establish 9 purchasing preferences for local producers of food and local 10 beverage providers. 11 The bill also requires the state board of regents and the 12 department of education, in collaboration with the department 13 of agriculture and land stewardship, to convene a task force 14 that will propose a procurement policy and implementation 15 timeline requiring all cafeterias at the campuses of the 16 university of northern Iowa, Iowa state university, the 17 university of Iowa, and all community colleges to conform to 18 specified dietary guidelines, and to establish purchasing 19 preferences for local producers of food and local beverage 20 providers. 21 The bill requires the task forces to submit their 22 procurement policies and implementation timelines to the 23 general assembly by January 2, 2015. 24 The department of administrative services, state board of 25 regents, and department of education shall each adopt a plan 26 requiring cafeteria conformity to the dietary guidelines and 27 purchasing preferences for local producers by January 1, 2016. 28 Every five years, beginning in 2019, the department of 29 administrative services and the department of public health 30 shall review and update the dietary guidelines to reflect 31 advancements in nutrition science, dietary data, and food 32 product availability. 33 -3- LSB 5527YH (5) 85 jb/rj 3/ 3
