H.F. 2319 Section 1. Section 272C.4, Code 2014, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 11. Adopt rules by January 1, 2015, to 3 provide credit towards qualifications for licensure to practice 4 an occupation or profession in this state for education, 5 training, and service obtained or completed by an individual 6 while serving honorably on federal active duty, state active 7 duty, or national guard duty, as defined in section 29A.1, 8 to the extent consistent with the qualifications required 9 by the appropriate licensing board. The rules shall also 10 provide credit towards qualifications for initial licensure 11 for education, training, or service obtained or completed by 12 an individual while serving honorably in the military forces 13 of another state or the organized reserves of the armed 14 forces of the United States, to the extent consistent with the 15 qualifications required by the appropriate licensing board. 16 NEW SUBSECTION . 12. a. Establish procedures by January 17 1, 2015, to expedite the licensing of an individual who is 18 licensed in a similar profession or occupation in another state 19 and who is a veteran, as defined in section 35.1, or the spouse 20 of a veteran. 21 b. If the board determines that the professional or 22 occupational licensing requirements of the state where the 23 veteran or veteran’s spouse is licensed are substantially 24 equivalent to the licensing requirements of this state, the 25 procedures shall require the licensing of the veteran or the 26 veteran’s spouse in this state. 27 c. If the board determines that the professional or 28 occupational licensing requirements of the state where the 29 veteran or veteran’s spouse is licensed are not substantially 30 equivalent to the professional or occupational licensing 31 requirements of this state, the procedures shall allow the 32 provisional licensing of the veteran or veteran’s spouse for 33 a period of time deemed necessary by the board to obtain a 34 substantial equivalent to the licensing requirements of this 35 -1- LSB 6116HV (1) 85 aw/sc 1/ 3

The board shall advise the veteran or the veteran’s 1 spouse of required education or training necessary to obtain 2 a substantial equivalent to the professional or occupational 3 licensing requirements of this state, and the procedures shall 4 provide for licensing of an individual who has, pursuant to 5 this paragraph, obtained a substantial equivalent to the 6 professional or occupational licensing requirements of this 7 state. 8 NEW SUBSECTION . 13. Beginning December 15, 2016, annually 9 file a report with the governor and the general assembly 10 providing information and statistics on credit received by 11 individuals for education, training, and service pursuant to 12 subsection 11 and information and statistics on licenses and 13 provisional licenses issued pursuant to subsection 12. 14 NEW SUBSECTION . 14. Notwithstanding the designation 15 of the licensing boards in section 272C.1, the provisions 16 of subsections 11 through 13 shall apply to all of the 17 occupational and professional licensing boards of this state. 18 Sec. 2. REPORT. Each occupational and professional 19 licensing board of this state shall file a report with the 20 governor and the general assembly by January 31, 2015, on the 21 substance of rules and procedures adopted to implement the 22 provisions of this division of this Act. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill relates to professional and occupational licensure 27 of veterans and the spouses of veterans. 28 The bill amends Code section 272C.4 to require that all 29 professional and occupational licensing boards adopt rules 30 by January 1, 2015, to provide credit towards licensing for 31 education, training, and service that is either obtained or 32 completed by an individual while serving on federal active 33 duty, state active duty, or national guard duty. H.F. 2319 licensure for service in the military forces of other states 1 or the organized reserves of the armed forces of the United 2 States. Code section 272C.1 provides that the term “licensing” 3 and its derivations include the terms “registration” and 4 “certification” and their derivations. 5 The bill also requires that licensing boards establish 6 procedures to expedite the licensing in this state of 7 certain individuals who are licensed to practice in a similar 8 profession or occupation in another state if the individual 9 is a veteran or the spouse of a veteran and if the board 10 determines that the licensing requirements of the other state 11 are substantially equivalent to the licensing requirements 12 of this state. The bill also requires that if the board 13 determines that another state’s licensing requirements are 14 not substantially equivalent to the licensing requirements of 15 this state, the board shall issue a provisional license to 16 the qualifying veteran or the qualifying spouse of a veteran 17 for a period of time deemed necessary to obtain a substantial 18 equivalent to the licensing requirements of this state. 19 The bill requires that occupational and professional 20 licensing boards provide a report to the governor and to the 21 general assembly by December 15, 2016, on the awarding of 22 credits for qualifying education, training, and service and on 23 licensing and provisional licensing awarded under the bill. 24 The bill requires that each occupational and professional 25 licensing board report to the governor and the general 26 assembly by January 31, 2015, on the substance of the rules and 27 procedures adopted to carry out the provisions of the bill. 28 -3- LSB 6116HV (1) 85 aw/sc 3/ 3
