135.11,
subsection
28,
Code
2014,
is

amended
to
read
as
follows:

28.
In
consultation
with
the
advisory
committee
for
3
perinatal
guidelines,
develop
and
maintain
the
statewide
4
perinatal
program
based
on
the
recommendations
of
the
5
American
academy
of
pediatrics
and
the
American
college
of
6
obstetricians
and
gynecologists
contained
in
the
most
recent
7
edition
of
the
guidelines
for
perinatal
care,
and
shall
8
adopt
rules
in
accordance
with
chapter
17A
to
implement
those
9
recommendations.
Hospitals
within
the
state
shall
determine
10
whether
to
participate
in
the
statewide
perinatal
program,
and
11
select
the
hospital’s
level
of
participation
in
the
program.
12
A
hospital
having
determined
to
participate
in
the
program
13
shall
comply
with
the
guidelines
appropriate
to
the
level
of
14
participation
selected
by
the
hospital.
Participation
shall
15
include
prearranged
consultative
agreements
between
two
or
more
16
hospital
perinatal
units.
Prearranged
consultative
agreements
17
may
include
direct
care
of
the
patient
or
utilization
of
18
telemedicine
or
telephone
consultation
to
qualify
a
hospital
19
for
a
higher
level
of
participation
and
a
higher
reimbursement
20
rate
under
the
medical
assistance
program.
Perinatal
program
21
surveys
and
reports
are
privileged
and
confidential
and
are
22
not
subject
to
discovery,
subpoena,
or
other
means
of
legal
23
compulsion
for
their
release
to
a
person
other
than
the
24
affected
hospital,
and
are
not
admissible
in
evidence
in
a
25
judicial
or
administrative
proceeding
other
than
a
proceeding
26
involving
verification
of
the
participating
hospital
under
this
27
subsection
.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
30
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
a
hospital’s
participation
in
the

state’s
perinatal
program.
The
bill
requires
participation
to
33
include
prearranged
consultative
agreements
between
hospitals.

The
bill
allows
the
consultative
agreements
to
include
direct
