H.F. 2285 Section 1. JUVENILE DETENTION STUDY. 1 1. The public safety advisory board established within 2 the division of criminal and juvenile justice planning of the 3 department of human rights shall study the use of juvenile 4 detention in this state. The public safety advisory board 5 shall discuss and evaluate the approaches currently taken 6 across this state for making juvenile detention decisions; 7 the appropriateness of using juvenile detention screening 8 instruments; the use and effectiveness of juvenile detention 9 screening instruments used in this state, contemplated to 10 be used in this state, and used out of state; the juvenile 11 detention screening instrument’s effect on overrepresentation 12 or disproportionate minority contact in juvenile detention; 13 the offenses for which juvenile detention is appropriate; 14 a juvenile detention screening instrument’s effect on the 15 types of offenses for which juvenile detention is appropriate; 16 and other matters the public safety advisory board deems 17 appropriate. 18 2. The public safety advisory board shall develop 19 recommendations concerning juvenile detention admissions and 20 screening, juvenile detention screening instruments, and other 21 issues deemed appropriate by the board. The public safety 22 advisory board shall, by December 15, 2014, submit a report 23 of its findings and recommendations to the governor and the 24 general assembly. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill requires the public safety advisory board to 29 study and report on juvenile detention. The bill requires 30 the board to discuss and evaluate the current method for 31 determining whether to place juveniles in detention, and the 32 appropriateness of juvenile detention screening instruments 33 and their use in this state and out of state, as well as 34 the juvenile detention screening instrument’s impact on 35 -1- LSB 5932YH (4) 85 ad/rj 1/ 2
H.F. 2285 disproportionate minority contact in juvenile detention. The 1 board also shall discuss offenses that should or should not 2 entail juvenile detention and a juvenile detention screening 3 instrument’s impact on the types of offenses for which a person 4 is placed in juvenile detention. 5 The bill requires the board to develop recommendations and 6 present its findings and recommendations in a report to the 7 governor and the general assembly by December 15, 2014. 8 -2- LSB 5932YH (4) 85 ad/rj 2/ 2
