H.F. 2266 Section 1. Section 144.46, subsection 2, Code 2014, is 1 amended to read as follows: 2 2. Fees collected by the state registrar and by the county 3 registrar on behalf of the state under this section shall 4 be deposited in the general fund of the state and the vital 5 records fund established in section 144.46A in accordance with 6 an apportionment established by rule. Fees Those fees or 7 portions of fees to be retained by the county when collected by 8 the county registrar pursuant to section 331.605, subsection 9 1 , paragraph paragraphs “f” and “g” , shall be deposited in the 10 county general fund. 11 Sec. 2. Section 331.605, subsection 1, paragraph g, Code 12 2014, is amended to read as follows: 13 g. For filing an application for the license to marry, 14 thirty-five dollars, which includes payment for one certified 15 copy of the original certificate of marriage, to be issued 16 following filing of the original certificate of marriage, four 17 fourteen dollars of which shall be retained by the county 18 pursuant to paragraph “f” . For issuing an application for an 19 order of the district court authorizing the validation of a 20 license to marry before the expiration of three days from the 21 date of issuance of the license, five dollars. The district 22 court shall authorize the early validation of a marriage 23 license without the payment of any fees imposed in this 24 paragraph upon showing that the applicant is unable to pay the 25 fees. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill increases the amount of the portion of the fee for 30 a marriage license retained by the county from $4 to $14. 31 -1- LSB 5724HV (2) 85 ad/sc 1/ 1
