1.
Section
260C.14,
Code
2014,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
24.
Require
prospective
and
current
3
employees
whose
regular
duties
involve
working
with
or
4
providing
instruction
to
students
who
are
less
than
age
5
eighteen
or
are
age
eighteen
or
older
and
enrolled
in
high
6
school
to
be
subject
to
employment
background
checks.
The
7
background
checks
shall
be
performed
before
the
work
with
or
8
provision
of
instruction
begins.
The
background
checks
shall
9
include
but
are
not
limited
to
criminal
history
and
child
and
10
dependent
abuse
registry
checks
in
this
state.
In
addition,
11
the
prospective
or
current
employee’s
fingerprints
shall
be
12
provided
to
the
department
of
public
safety
for
submission
13
through
the
state
criminal
history
repository
to
the
United
14
States
department
of
justice,
federal
bureau
of
investigation,
15
for
a
national
criminal
history
check.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
mandates
that
the
board
of
directors
of
a
community
20
college
require
background
checks
of
prospective
and
current
21
employees
whose
regular
duties
involve
working
with
or
22
providing
instruction
to
students
who
are
less
than
age
18
or
23
are
age
18
or
older
and
enrolled
in
high
school.
24
The
background
checks
are
to
be
performed
before
the
duties
25
involving
such
students
begin
and
are
to
include
criminal
26
history
and
child
and
dependent
abuse
registry
checks
in
this
27
state.
In
addition,
the
prospective
or
current
employee’s
28
fingerprints
are
to
be
provided
for
a
national
criminal
history
29
check.
