H.F. 2212 Section 1. NEW SECTION . 455D.17 Used home appliance 1 recycling and disposal. 2 1. For purposes of this section, “home appliance” means 3 a refrigerator, window air conditioning unit, humidifier, or 4 other similar appliance as defined by the commission by rule. 5 2. A county shall accept and collect used home appliances 6 for reuse, recycling, or proper disposal. The commission 7 shall adopt rules governing methods of disposal which shall 8 constitute proper disposal. A county may assess a fee for 9 providing services under this subsection. 10 3. This section shall not apply to a county when the 11 services described in subsection 2 are provided within the 12 county by another person or entity. 13 Sec. 2. IMPLEMENTATION OF ACT. The fees and funds generated 14 as a result of the enactment of this Act are intended to cover 15 the costs of any state mandate included in this Act and this 16 specification of state funding shall be deemed to meet all the 17 state funding-related requirements of section 25B.2, subsection 18 3, and no additional state funding shall be necessary for the 19 full implementation of this Act by, and enforcement of this Act 20 against, all affected political subdivisions. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill requires a county to accept and collect used home 25 appliances for reuse, recycling, or proper disposal. A county 26 may assess a fee for providing the service. A county is not 27 required to provide the service if another person or entity 28 provides such services within the county. 29 The bill provides that a “home appliance” is a refrigerator, 30 window air conditioning unit, humidifier, or other similar 31 appliance as defined by the environmental protection commission 32 by rule. 33 The bill may include a state mandate as defined in Code 34 section 25B.3. H.F. 2212 as a result of the bill are intended to cover the costs of any 1 state mandate included in the bill.
