H.F. 2194 Section 1. Section 257.8, subsections 1 and 2, Code 2014, 1 are amended to read as follows: 2 1. State percent of growth. The state percent of growth 3 for the budget year beginning July 1, 2012, is two percent. 4 The state percent of growth for the budget year beginning July 5 1, 2013, is two percent. The state percent of growth for the 6 budget year beginning July 1, 2014, is four percent. The state 7 percent of growth for each subsequent budget year shall be 8 established by statute which shall be enacted within thirty 9 days of the submission in the year preceding the base year of 10 the governor’s budget under section 8.21 as provided in this 11 subsection . The statute establishing the state percent of 12 growth for a budget year beginning July 1 of an odd-numbered 13 calendar year shall be enacted within thirty days of the 14 submission of the governor’s budget under section 8.21 in that 15 odd-numbered calendar year. The statute establishing the state 16 percent of growth for a budget year beginning July 1 of an 17 even-numbered calendar year shall be enacted during the regular 18 legislative session preceding the base year. The establishment 19 of the state percent of growth for a budget year shall be the 20 only subject matter of the bill which enacts the state percent 21 of growth for a budget year. 22 2. Categorical state percent of growth. The categorical 23 state percent of growth for the budget year beginning July 24 1, 2012, is two percent. The categorical state percent of 25 growth for the budget year beginning July 1, 2013, is two 26 percent. The categorical state percent of growth for the 27 budget year beginning July 1, 2014, is four percent. The 28 categorical state percent of growth for each budget year shall 29 be established by statute which shall be enacted within thirty 30 days of the submission in the year preceding the base year of 31 the governor’s budget under section 8.21 as provided in this 32 subsection . The statute establishing the categorical state 33 percent of growth for a budget year beginning July 1 of an 34 odd-numbered calendar year shall be enacted within thirty days 35 -1- LSB 6095HV (1) 85 md/sc 1/ 3
H.F. 2194 of the submission of the governor’s budget under section 8.21 1 in that odd-numbered calendar year. The statute establishing 2 the categorical state percent of growth for a budget year 3 beginning July 1 of an even-numbered calendar year shall be 4 enacted during the regular legislative session preceding the 5 base year. The establishment of the categorical state percent 6 of growth for a budget year shall be the only subject matter of 7 the bill which enacts the categorical state percent of growth 8 for a budget year. The categorical state percent of growth 9 may include state percents of growth for the teacher salary 10 supplement, the professional development supplement, the early 11 intervention supplement, and the teacher leadership supplement. 12 Sec. 2. APPLICABILITY. This Act applies to school budget 13 years beginning on or after July 1, 2015. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill modifies the requirements for enacting the state 18 percent of growth and the categorical state percent of growth 19 under Code section 257.8. 20 Current law requires the state percent of growth and the 21 categorical state percent of growth to be established by 22 statute within 30 days of the submission of the governor’s 23 budget in the year preceding the base year. 24 The bill requires the statute establishing the state percent 25 of growth and the categorical state percent of growth for 26 a budget year beginning July 1 of an odd-numbered calendar 27 year to be enacted within 30 days of the submission of the 28 governor’s budget in that odd-numbered calendar year. The 29 bill requires the statute establishing the state percent of 30 growth and the categorical state percent of growth for a budget 31 year beginning July 1 of an even-numbered calendar year to be 32 enacted during the regular legislative session preceding the 33 base year. 34 The bill applies to school budget years beginning on or after 35 -2- LSB 6095HV (1) 85 md/sc 2/ 3
