H.F. 2144 Section 1. NEW SECTION . 723.6 Disorderly conduct —— 1 exposure. 2 1. A person who exposes the person’s genitals or pubes 3 to another not the person’s spouse if the person knows or 4 reasonably should know that the act is offensive to the viewer. 5 2. A person who violates this section commits a simple 6 misdemeanor. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill establishes exposure as a disorderly conduct 11 criminal offense. 12 Under the bill, a person commits disorderly conduct by 13 exposing the person’s genitals or pubes to another not the 14 person’s spouse if the person knows or reasonably should know 15 the act is offensive to the viewer. 16 A person who violates the bill commits a simple misdemeanor 17 and is not required to register as a sex offender as one who 18 commits indecent exposure under Code section 709.9. 19 A simple misdemeanor is punishable by confinement for no 20 more than 30 days or a fine of at least $65 but not more than 21 $625 or by both. 22 -1- LSB 5578YH (2) 85 jm/rj 1/ 1
