NEW SECTION . 8A.417A False allegations —— 1 discipline —— civil penalty. 2 A state employee who makes an allegation concerning another 3 state employee that results in an investigation of the other 4 state employee for possible discipline or discharge shall 5 be subject to discipline or discharge if the allegation is 6 determined to be false and the state employee making the 7 allegation knew, or should have known, that the allegation was 8 false and without merit. A state employee who makes a false 9 allegation as described in this section and who is subject to 10 discipline or discharge under this section shall, as part of 11 that discipline or discharge, be subject to a civil penalty of 12 five thousand dollars. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill provides that a state employee who makes a false 17 allegation that results in an investigation of another state 18 employee for possible discipline or discharge shall be subject 19 to possible discipline or discharge for the false allegation if 20 the state employee making the allegation knew, or should have 21 known, that the allegation was false and without merit.
