H.F. 2133 Section 1. Section 719.1, subsection 2, unnumbered 1 paragraph 1, Code 2014, is amended to read as follows: 2 A person under the custody, control, or supervision of 3 the department of corrections , a county jail, or a municipal 4 holding facility, commits interference with official acts when 5 the person knowingly resists, obstructs, or interferes with a 6 correctional officer, jailer, agent, employee, or contractor, 7 whether paid or volunteer, in the performance of the person’s 8 official duties. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill relates to interference with official acts. 13 Under the bill, a person under the custody, control, or 14 supervision of a county jail or municipal holding facility who 15 knowingly resists, obstructs, or interferes with a jailer, 16 agent, employee, or contractor in the performance of the 17 official duties of the jailer, agent, employee, or contractor 18 commits interference with official acts. 19 The criminal offense for the commission of interference 20 with official acts pursuant to the bill ranges from a serious 21 misdemeanor through a class “C” felony depending upon the facts 22 of the offense under Code section 719.1(2). 23 A person who assaults a jailer may also be punished pursuant 24 to the existing provisions of Code section 708.3A. 25 -1- LSB 5115HV (1) 85 jm/nh 1/ 1
