H.F. 2064 Section 1. Section 321.236, subsection 6, Code 2014, is 1 amended to read as follows: 2 6. Designating any a highway as a through highway and 3 requiring that all vehicles stop or yield the right-of-way 4 before entering or crossing the same or designating any an 5 intersection as a stop intersection and requiring all vehicles 6 to stop at one or more entrances to such intersections , 7 consistent with section 321.255A . 8 Sec. 2. NEW SECTION . 321.255A Intersections requiring stop 9 or yield signs. 10 1. At each intersection of two different highways 11 having speed limits above 35 miles per hour, an official 12 traffic control device shall be placed at the entrance to 13 the intersection in both directions along the least-traveled 14 highway, directing traffic to stop or yield the right-of-way 15 before entering the intersection. 16 2. This section shall not apply to an intersection 17 controlled by an official traffic control signal or to an 18 intersection where official traffic control devices direct 19 traffic approaching from every direction to stop or yield 20 before entering the intersection. 21 Sec. 3. IMPLEMENTATION OF ACT. Section 25B.2, subsection 22 3, shall not apply to this Act. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill requires that at every intersection of two 27 highways having a speed limit above 35 miles per hour, a 28 stop or yield sign must be posted at the entrance to the 29 intersection in both directions along the least-traveled 30 highway. The requirement does not apply at intersections with 31 official traffic control signals or at intersections that are 32 posted in all directions with stop or yield signs. 33 Pursuant to current law, local authorities may designate 34 through highways and intersections where vehicles must stop or 35 -1- LSB 5425YH (3) 85 dea/nh 1/ 2
H.F. 2064 yield. The bill states that the exercise of that authority 1 must be consistent with the requirements of the bill. 2 The bill may include a state mandate as defined in Code 3 section 25B.3. The bill makes inapplicable Code section 25B.2, 4 subsection 3, which would relieve a political subdivision from 5 complying with a state mandate if funding for the cost of 6 the state mandate is not provided or specified.
