H.F. 2055 Section 1. Section 22.7, subsection 13, Code 2014, is 1 amended to read as follows: 2 13. a. The Except as otherwise provided in paragraphs “b” 3 and “c” , records of a library which, by themselves or when 4 examined with other public records, would reveal the identity 5 of the library patron checking out or requesting an item or 6 information from the library. 7 b. The records shall be released to a criminal or 8 juvenile justice agency only pursuant to an investigation of 9 a particular person or organization suspected of committing 10 a known crime. The records shall be released only upon a 11 judicial determination that a rational connection exists 12 between the requested release of information and a legitimate 13 end and that the need for the information is cogent and 14 compelling. 15 c. The records shall be released to the parent or guardian 16 of a library patron who is a minor child upon the request of the 17 parent or guardian. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 Under Iowa Code section 22.7, library records which, by 22 themselves or when examined with other public records, would 23 reveal the identity of the library patron checking out or 24 requesting an item or information from the library shall be 25 kept confidential unless otherwise allowed by a court, by the 26 lawful custodian of the records, or by another person duly 27 authorized to release such information. However, the Code 28 section does allow the release of library records to a criminal 29 or juvenile justice agency only pursuant to an investigation 30 of a particular person or organization suspected of committing 31 a known crime and only upon a judicial determination that a 32 rational connection exists between the requested release of 33 information and a legitimate end and that the need for the 34 information is cogent and compelling. 35 -1- LSB 5503YH (8) 85 rh/rj 1/ 2
