H.F. 2046 Section 1. NEW SECTION . 476A.7A Nuclear generating 1 facilities —— threshold determination requirements —— general 2 assembly approval. 3 1. In addition to any other requirements for issuance of a 4 certificate pursuant to this chapter, a certificate shall not 5 be issued for the construction of a nuclear generating facility 6 until the director of the department of natural resources 7 certifies that an authorized agency of the federal government 8 has identified and approved a demonstrable technology or 9 means for disposal of high-level nuclear waste, and until 10 construction of the facility has been specifically approved by 11 a majority vote of both houses of the general assembly. 12 2. As used in this section, “high-level nuclear waste” means 13 those aqueous wastes resulting from the operation of the first 14 cycle of the solvent extraction system or equivalent and the 15 concentrated wastes of the subsequent cycles or equivalent in 16 a facility for reprocessing irradiated reactor fuel and shall 17 include spent fuel assemblies prior to fuel reprocessing. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill restricts the issuance of a certificate of public 22 convenience, use, and necessity for nuclear generating facility 23 applicants until specified requirements are met. 24 The bill provides that in addition to any other requirements 25 for issuance of a certificate of public convenience, use, and 26 necessity by the Iowa utilities board pursuant to Code chapter 27 476A, a certificate shall not be issued for the construction 28 of a nuclear generating facility until the director of the 29 department of natural resources certifies that an authorized 30 agency of the federal government has identified and approved 31 a demonstrable technology or means for disposal of high-level 32 nuclear waste, and until construction of the facility has been 33 specifically approved by a majority vote of both houses of 34 the general assembly.
