Implementation
of
federal
law

policy.

1.
Except
as
otherwise
explicitly
established
by
state
law,

a
state
administrative
agency
charged
with
the
implementation
4
of
federal
law
or
policy
shall
not
exceed
the
specific
5
requirements
of
that
law
or
policy.

Any
state
administrative
agency
rule
or
policy
that
is
in
7
violation
of
subsection
1
is
void.

EXPLANATION
9
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
10
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
state
implementation
of
federal
law
12
or
policy
by
a
state
administrative
agency
shall
not
exceed
13
the
specific
requirements
of
the
federal
law
or
policy,
except
14
as
specifically
allowed
by
state
law.
Any
rule
or
policy
in
15
violation
of
this
requirement
is
void.
