Section
256B.9,
subsection
7,
Code
2013,
is

amended
to
read
as
follows:

7.
a.
The
costs
of
special
education
instructional
programs

include
the
costs
of
purchase
of
transportation
equipment
4
to
meet
the
special
needs
of
children
requiring
special
5
education
with
the
approval
of
the
director
of
the
department
6
of
education.
7
b.
The
department
of
education
shall
administer
the
costs
of
8
special
education
instructional
programs
when
contracted
with
a
9
private
agency
that
provides
residential
treatment
services
to
10
meet
the
special
needs
of
children
requiring
special
education,
11
which
costs
include
costs
of
general
administration,
health
12
service,
attendance
officers,
plant
operation,
and
plant
13
maintenance;
regular
and
special
instructional
costs;
overhead
14
costs;
and
the
costs
of
purchase
of
equipment,
transportation,
15
and
insurance.

c.
The
state
board
of
education
shall
adopt
rules
under
17
chapter
17A
for
the
purchase
of
transportation
equipment
18
pursuant
to
administer
this
section
.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
20
immediate
importance,
takes
effect
upon
enactment.

Sec.
3.
RETROACTIVE
APPLICABILITY.
This
Act
applies
22
retroactively
to
July
1,
2012.

EXPLANATION
24
This
bill
directs
the
department
of
education
to
administer
25
the
costs
of
special
education
instructional
programs
when
26
contracted
with
a
private
agency
that
provides
residential
27
treatment
services
to
meet
the
special
needs
of
children
28
requiring
special
education.
Such
costs
include
costs
of
29
general
administration,
health
service,
attendance
officers,
30
plant
operation,
and
plant
maintenance;
regular
and
special
31
instructional
costs;
overhead
costs;
and
the
costs
of
purchase
32
of
equipment,
transportation,
and
insurance.
33
The
bill
takes
effect
upon
enactment
and
applies
34
retroactively
to
July
1,
2012.
