H.F. 2014 Section 1. Section 21.2, subsection 1, Code 2014, is amended 1 to read as follows: 2 1. “Governmental body” means: 3 a. A board, council, commission, or other governing body 4 expressly created by the statutes of this state or by executive 5 order. 6 b. A board, council, commission, or other governing body 7 of a political subdivision or tax-supported district in this 8 state. 9 c. A multimembered body formally and directly created by 10 one or more boards, councils, commissions, or other governing 11 bodies subject to paragraphs paragraph “a” and or “b” of this 12 subsection . 13 d. Those multimembered bodies to which the state board 14 of regents or a president of a university has delegated 15 the responsibility for the management and control of the 16 intercollegiate athletic programs at the state universities. 17 e. An advisory board, advisory commission, or task force 18 created by the governor or the general assembly to develop and 19 make recommendations on public policy issues. 20 f. e. A nonprofit corporation other than a fair conducting 21 a fair event as provided in chapter 174 , whose facilities or 22 indebtedness are supported in whole or in part with property 23 tax revenue and which is licensed to conduct pari-mutuel 24 wagering pursuant to chapter 99D or a nonprofit corporation 25 which is a successor to the nonprofit corporation which built 26 the facility. 27 g. f. A nonprofit corporation licensed to conduct gambling 28 games pursuant to chapter 99F . 29 h. An advisory board, advisory commission, advisory 30 committee, task force, or other body created by statute or 31 executive order of this state or created by an executive order 32 of a political subdivision of this state to develop and make 33 recommendations on public policy issues. 34 i. g. H.F. 2014 as provided in chapter 468 , including a board as defined in 1 section 468.3 , regardless of how the district is organized. 2 j. h. An advisory board, advisory commission, advisory 3 committee, task force, or other body created by an An entity 4 or a joint board established or organized pursuant to an 5 agreement under chapter 28E , or by the administrator or joint 6 board specified in a chapter 28E agreement, to develop and make 7 recommendations on public policy issues unless the agreement 8 includes public agencies from more than one state . 9 i. An advisory board, advisory commission, advisory 10 committee, task force, or other body created by any of the 11 following to develop and make recommendations on public policy 12 issues: 13 (1) The governor or the general assembly. 14 (2) A statute or executive order of this state. 15 (3) An executive order or motion, resolution, or ordinance 16 of a political subdivision of this state. 17 (4) A governmental body as defined in paragraphs “a” through 18 “h” . 19 Sec. 2. Section 21.11, Code 2014, is amended to read as 20 follows: 21 21.11 Applicability to nonprofit corporations. 22 This chapter applies to nonprofit corporations which 23 are defined as governmental bodies subject to section 21.2, 24 subsection 1 , paragraph “f” “e” , only when the meetings 25 conducted by the nonprofit corporations relate to the conduct 26 of pari-mutuel racing and wagering pursuant to chapter 99D . 27 Sec. 3. Section 22.1, subsection 1, Code 2014, is amended 28 to read as follows: 29 1. The term “government body” means this state, or 30 any county, city, township, school corporation, political 31 subdivision, tax-supported district, nonprofit corporation 32 other than a fair conducting a fair event as provided in 33 chapter 174 , whose facilities or indebtedness are supported 34 in whole or in part with property tax revenue and which is 35 -2- LSB 5058HH (3) 85 rh/rj 2/ 3

H.F. 2014 licensed to conduct pari-mutuel wagering pursuant to chapter 1 99D ; the governing body of a drainage or levee district as 2 provided in chapter 468 , including a board as defined in 3 section 468.3 , regardless of how the district is organized; 4 or other entity of this state , ; or any branch, department, 5 board, bureau, commission, council, or committee including 6 any advisory board, advisory commission, advisory committee, 7 or task force , official, or officer of any of the foregoing 8 entities enumerated in this subsection or any employee 9 delegated the responsibility for implementing the requirements 10 of this chapter . 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill relates to meetings of advisory boards, advisory 15 committees, advisory commissions, and task forces under Iowa’s 16 open meetings and public records laws. 17 The bill amends the definition of governmental body for 18 purposes of the open meetings law (Code chapter 21) to provide 19 that all advisory bodies created by the governor, general 20 assembly, statute or executive order of this state, executive 21 order or motion, resolution, or ordinance of a political 22 subdivision of this state, or a governmental body defined 23 in Code section 21.2, subsection 1, to develop and make 24 recommendations on public policy issues, are subject to the 25 requirements of the open meetings law. 26 The bill amends the definition of government body for 27 purposes of the public records law to provide that any advisory 28 board, advisory council, advisory commission, or task force of 29 a government body defined in Code section 22.1, subsection 1, 30 is subject to the requirements of the public records law. 31 -3- LSB 5058HH (3) 85 rh/rj 3/ 3
