is
amended
to
read
as
follows:

(iii)
Have
been
screened
for
breast
and
cervical
cancer

under
the
United
States
centers
for
disease
control
and

prevention
breast
and
cervical
cancer
early
detection
program

established
under
42
U.S.C.
§
300k
et
seq.,
in
accordance
with

the
requirements
of
42
U.S.C.
§
300n,
and
need
treatment
for
8
breast
or
cervical
cancer.
A
woman
is
considered
screened
for
9
breast
and
cervical
cancer
under
this
subparagraph
subdivision
10
if
the
woman
is
screened
by
any
provider
or
entity,
and
the
11
state
grantee
of
the
United
States
centers
for
disease
control
12
and
prevention
funds
under
Tit.
XV
of
the
federal
Public
Health
13
Services
Act
has
elected
to
include
screening
activities
by
14
that
provider
or
entity
as
screening
activities
pursuant
to
15
Tit.
XV
of
the
federal
Public
Health
Services
Act.
This
16
screening
includes
but
is
not
limited
to
breast
or
cervical
17
cancer
screenings
or
related
diagnostic
services
provided
18
by
family
planning
or
community
health
centers
and
breast
19
cancer
screenings
funded
by
the
Susan
G.
Komen
foundation
20
nonprofit
organizations
which
are
provided
to
women
who
meet
21
the
eligibility
requirements
established
by
the
state
grantee
22
of
the
United
States
centers
for
disease
control
and
prevention
23
funds
under
Tit.
XV
of
the
federal
Public
Health
Services
Act.

Sec.
2.
MEDICAID
STATE
PLAN
AMENDMENT.
The
department
of

human
services
shall
submit
a
medical
assistance
state
plan
26
amendment
to
the
centers
for
Medicare
and
Medicaid
services
of
27
the
United
States
department
of
health
and
human
services
to
28
provide
for
applicability
of
the
federal
Breast
and
Cervical
29
Cancer
Prevention
and
Treatment
Act
of
2000,
Pub.
L.
No.
30
106-354,
to
both
men
and
women.

EXPLANATION

This
bill
relates
to
the
federal
Breast
and
Cervical
Cancer

Prevention
and
Treatment
Act
of
2000
and
its
application
to

Medicaid.
The
bill
amends
the
reference
in
the
Medicaid

of

cancer

screenings
to
provide
that
any
nonprofit
organization,
not

only
specifically
the
Susan
G.
Komen
foundation,

funds

provide
the
screening
for
the
program.
The
bill
also

directs
the
department
of
human
services
to
submit
a
medical

assistance
state
plan
amendment
to
the
centers
for
Medicare
and

Medicaid

provide
for

the

Cancer
Prevention
and
Treatment
Act
