H.F. 123 Section 1. NEW SECTION . 455B.317 Product stewardship —— 1 report. 2 1. By January 15 of each year, the department shall submit a 3 product stewardship report to the general assembly. The report 4 shall supply information identifying solid waste according 5 to product or product category. The report shall consider 6 latex paint, oil-based paint, aseptic packaging, waste tires, 7 florescent bulbs, and food waste. The report shall not include 8 consideration of motor vehicles or watercraft. 9 2. The department shall use the report described in 10 subsection 1 to recommend a strategy that most efficiently 11 manages solid waste as classified according to product 12 or product category. The strategy shall at least include 13 recommendations for all of the following: 14 a. Disposing of hazardous chemicals, toxic materials, or 15 harmful physical agents that pose a risk of an adverse impact 16 to the environment or public health and safety. 17 b. Increasing the recovery of materials for reuse or 18 recycling. 19 c. Reducing costs associated with solid waste management. 20 3. In preparing its report, the department shall consider 21 how other states have classified solid waste according to 22 products and product categories and how other states have 23 successfully collected and managed solid waste, including 24 recovering and recycling efforts. When preparing the report, 25 the department shall consult with landfill operators and 26 businesses engaged in recycling solid waste. The department 27 shall also invite participation from interested members of the 28 public. 29 4. As part of its report, the department shall recommend the 30 establishment of a product stewardship program that implements 31 or improves upon the strategy developed by the department under 32 this section, including by detailing any legislative proposals 33 required for implementation or explaining the adoption of 34 proposed rules under existing statutory authority. 35 -1- LSB 1192HH (2) 85 da/nh 1/ 2

H.F. 123 EXPLANATION 1 This bill requires the department of natural resources to 2 prepare and submit a product stewardship report to the general 3 assembly each year. The report shall supply information 4 identifying solid waste according to product or product 5 category. The department must use the report to recommend 6 a strategy that most efficiently manages solid waste as 7 classified according to product or product category.
