1.
NEW
SECTION
.
80B.11F
Public
safety
training
and
1
equipment
trust
fund.

1.
A
public
safety
training
and
equipment
trust
fund
is
3
created
in
the
state
treasury
under
the
control
of
the
council.
4
2.
The
trust
fund
shall
consist
of
moneys
deposited
in
5
the
fund
pursuant
to
section
432.1,
subsection
7,
and
any
6
other
devise,
gift,
bequest,
donation,
federal
or
other
grant,
7
reimbursement,
repayment,
judgment,
transfer,
payment,
or
8
appropriation
from
any
source
intended
to
be
used
for
the
9
purposes
of
the
trust
fund.
Of
the
moneys
deposited
in
the
10
trust
fund,
an
amount
equal
to
ten
percent
of
the
moneys
11
deposited,
or
such
lesser
amount
as
determined
by
the
council,
12
shall
be
allocated
to
a
capital
projects
account
for
the
13
purposes
of
facility
needs
of
the
academy.

Moneys
credited
to
the
trust
fund
are
not
subject
to
15
section
8.33
and
shall
not
be
transferred,
used,
obligated,
16
appropriated,
or
otherwise
encumbered
except
as
provided
17
in
this
section
and
for
succeeding
fiscal
years
shall
18
remain
available
for
expenditure
for
purposes
of
the
fund.

Notwithstanding
section
12C.7,
subsection
2,
interest
or
20
earnings
on
moneys
deposited
in
the
trust
fund
shall
be
21
credited
to
the
trust
fund.

4.
a.
Beginning
July
1,
2014,
moneys
in
the
trust
fund
23
shall
be
used
for
training
costs
at
the
academy
incurred
by
24
a
political
subdivision
of
the
state
and
for
law
enforcement
25
personnel
equipment
costs,
excluding
vehicles,
incurred
by
a
26
political
subdivision
of
the
state,
subject
to
appropriation
by
27
the
general
assembly.
It
is
the
intent
of
the
general
assembly
28
that
all
training
costs
incurred
by
a
political
subdivision
29
be
reimbursed
from
moneys
in
the
trust
fund
and
that
such
30
remaining
moneys
in
the
trust
fund,
less
such
amount
needed
for
31
cash
flow
purposes
of
the
trust
fund,
be
used
to
reimburse
law
32
enforcement
personnel
equipment
costs
in
such
manner
as
the
33
council
shall
determine.

2.
Section
432.1,
Code
2011,
is
amended
by
adding
the
3
following
new
subsection:

NEW
SUBSECTION
.
7.
a.
Of
the
amount
of
premium
tax
5
receipts
collected
pursuant
to
subsection
3
for
the
2014
and
6
subsequent
calendar
years
and
deposited
in
the
general
fund
7
of
the
state,
the
department
of
revenue
shall
transfer
the
8
applicable
percent
of
such
amount
that
exceeds
the
amount
of
9
premium
tax
receipts
collected
pursuant
to
subsection
3
for
10
calendar
year
2012
to
the
public
safety
training
and
equipment
11
trust
fund
created
in
section
80B.11F.
12
b.
For
purposes
of
this
subsection,
“applicable
percent”
13
means
as
follows:
14
(1)
For
the
2014
through
2016
calendar
years,
one
hundred
15
percent.
16
(2)
For
the
2017
calendar
year,
seventy-five
percent.
17
(3)
For
the
2018
and
subsequent
calendar
years,
fifty
18
percent.

TASK
FORCE.
21
1.
A
public
safety
standards,
training,
and
facilities
task
22
force
is
established.
The
department
of
public
safety
shall
23
provide
administrative
support
for
the
task
force.
24
2.
The
task
force
shall
consist
of
the
following
members:
25
a.
Five
members
appointed
by
the
Iowa
law
enforcement
26
academy
council.
Of
the
members
appointed,
at
least
three
27
members
shall
be
nonsupervisory
employees
in
law
enforcement,
28
at
least
one
member
shall
be
a
peace
officer
in
the
department
29
of
public
safety,
at
least
one
member
shall
be
in
county
law
30
enforcement,
and
at
least
one
member
shall
be
in
city
law
31
enforcement.

b.
Five
members
appointed
by
the
state
fire
service
and
33
emergency
response
council.
Of
the
members
appointed,
at
least
34
three
members
shall
be
nonsupervisory
employees
in
fire
service

Chief
of
the
Iowa
fire
service
training
bureau
or
the

the
governor
who
is
a
public

member
with
demonstrated
knowledge
in
public
safety
and
related

training
issues.

The
members
of
the
task
force
shall
select
one
9
chairperson
and
one
vice
chairperson.
The
vice
chairperson
10
shall
preside
in
the
absence
of
the
chairperson.
Section
11
69.16A
shall
apply
to
the
appointed
members
of
the
task
force.

4.
The
task
force
shall
consider
and
develop
strategies
13
relating
to
public
safety
training
facility
governance
with
14
the
goal
of
all
public
safety
disciplines
being
represented.
15
Each
public
safety
discipline
shall
advise
the
task
force
16
by
developing
individual
training
policies
and
standards
as
17
determined
by
the
discipline’s
governing
bodies.
The
task
18
force
shall
also
develop
a
proposal
for
a
joint
public
safety
19
training
facility,
a
budget
for
construction
and
future
20
operation
of
this
facility,
and
potential
locations,
that
are
21
centrally
located
in
this
state,
for
the
facility.
22
5.
a.
The
task
force
shall
provide
interim
reports
to
the
23
general
assembly
by
December
31
of
each
year
concerning
the
24
activities
of
the
task
force
and
shall
submit
its
final
report,
25
including
its
findings
and
recommendations,
to
the
general
26
assembly
by
December
31,
2015.
27
b.
The
final
report
shall
include
but
not
be
limited
to
28
recommendations
concerning
the
following:
29
(1)
Consolidation
of
public
safety
governance
within
a
30
single
board
and
the
membership
of
the
board.
31
(2)
Development
of
a
consolidated
fire
and
police
public
32
safety
training
facility,
including
possible
locations,
33
building
recommendations,
and
financing
options.

Any
other
recommendations
relating
to
public
safety

TASK
FORCE

ADMINISTRATIVE
SUPPORT.
There
is
appropriated
3
from
the
general
fund
of
the
state
to
the
department
of
public
4
safety
for
the
fiscal
period
beginning
July
1,
2012,
and
ending
5
December
31,
2015,
the
following
amount,
or
so
much
thereof
as
6
is
necessary,
to
be
used
for
the
purposes
designated:

providing
administrative
support
for
the
public
safety
8
standards,
training,
and
facilities
task
force
as
enacted
in
9
this
Act:

EXPLANATION
12
This
bill
concerns
public
safety
training
and
facilities.
13
The
bill
establishes
a
public
safety
training
and
equipment
14
trust
fund
under
the
control
of
the
Iowa
law
enforcement
15
academy
council.
The
trust
fund
shall
consist
of
moneys
16
deposited
in
the
fund
from
premium
tax
receipts
as
provided
by
17
the
bill.
Of
the
moneys
deposited
in
the
fund,
10
percent,
18
or
such
lesser
amount
as
determined
by
the
council,
shall
be
19
allocated
to
a
capital
projects
account
of
the
trust
fund
and
20
shall
be
used
for
facility
needs
of
the
Iowa
law
enforcement
21
academy.
The
remaining
moneys
deposited
in
the
fund
shall
be
22
used
for
training
costs
at
the
academy
and
for
law
enforcement
23
personnel
equipment
costs,
excluding
vehicles,
all
incurred
by
24
a
political
subdivision
of
the
state,
subject
to
appropriation
25
by
the
general
assembly.
The
bill
provides
that
it
is
the
26
intent
of
the
general
assembly
that
training
costs
incurred
27
by
a
political
subdivision
be
fully
reimbursed
from
moneys
in
28
the
fund
and
that
the
remaining
moneys
in
the
fund,
less
an
29
amount
needed
for
cash
flow
purposes,
be
used
to
reimburse
law
30
enforcement
personnel
equipment
costs.
Moneys
in
the
fund
31
shall
not
revert
to
the
general
fund
of
the
state,
and
interest
32
and
earnings
on
moneys
in
the
fund
shall
remain
in
the
fund.

Code
section
432.1,
concerning
tax
on
gross
insurance
34
premiums,
is
amended
to
provide
that
the
applicable
percent
of

moneys
collected
from
premium
tax
receipts
on
insurance
1
policies,
other
than
life
insurance
policies,
in
excess
of
the
2
amount
collected
for
calendar
year
2012,
shall
be
transferred

to
the
public
safety
training
and
equipment
trust
fund
created
4
by
the
bill
beginning
with
premium
tax
receipts
received
during
5
calendar
year
2014.
The
bill
provides
that
the
applicable
6
percent
for
calendar
years
2014
through
2016
shall
be
100
7
percent,
for
calendar
year
2017,
75
percent,
and
for
subsequent
8
calendar
years,
50
percent.
9
The
bill
also
establishes
a
public
safety
standards,
10
training,
and
facilities
task
force.
The
department
of
public
11
safety
shall
provide
administrative
support
for
the
task
12
force
and
the
bill
appropriates
moneys
to
the
department
for
13
providing
this
support.
The
bill
specifies
the
membership
14
of
the
task
force
and
provides
that
the
task
force
shall
15
consider
and
develop
strategies
relating
to
public
safety
16
training
facility
governance
with
the
goal
of
all
public
safety
17
disciplines
being
represented.
Each
public
safety
discipline
18
shall
advise
the
task
force
by
developing
individual
training
19
policies
and
standards
as
determined
by
the
discipline’s
20
governing
bodies.
The
bill
requires
the
task
force
to
provide
21
interim
reports
to
the
general
assembly
by
December
31
of
each
22
year
and
to
submit
a
final
report,
including
its
findings
23
and
recommendations,
to
the
general
assembly
by
December
31,
24
2015.
The
bill
provides
that
the
final
report
shall
include
25
recommendations
concerning

safety

governance

a

training
facility,
